Resolution 21-018 - Resolution Approving the Purchase of a Dell VxRail Appliance Whereas, the Information Technology Department requests action to purchase a Dell VxRail Hyperconvergence Datacenter Appliance from NASPO Contract #16820 through CDW -G; and Whereas, the new Dell VxRail Appliance will replace the existing aging server and SAN infrastructure in City Hall and the Brookings Police Department, and will result in cost savings and energy savings; and Whereas, the 2021 IT Department has a budget amount of $67,500 for n ew server infrastructure equipment, and the total price of the appliance is less than that amount. Now, Therefore, Be It Resolved that the City contract with CDW -G in the amount of $63,860.55 be accepted. FIRST READING – Ordinance 21-003. An introduction and first reading was held on Ordinance 21-003, an Ordinance Amending Division 3 of Article V, Chapter 2 of the Code of Ordinances of the City of Brookings, and pertaining to the Brookings Disability Awareness Committee. Second Reading: March 9, 2021. FIRST READING – Ordinance 21-005. An introduction and first reading was held on Ordinance 21-005, an Ordinance Authorizing Supplemental Appropriation No. 2 to the 2021 Budget. Second Reading: March 9, 2021. Ordinance 21-004. A public hearing was held on Ordinance 21-004, an Ordinance revising Division 3 of Chapter 82 of the Code of Ordinances of the City of Brookings and Pertaining to Speed Zones in the City of Brookings, South Dakota. A motion was made by Council Member Niemeyer, seconded by Council Member Brink, that Ordinance 21-004 be approved. The motion failed by the following vote: Yes: 3 - Corbett, Niemeyer, and Brink No: 4 - Bacon, Wendell, Tilton Byrne, and Collins. Preliminary Plat. A motion was made by Council Member Niemeyer, seconded by Council Member Collins, that a revised Preliminary Plat for Lots 1-4, Block 18, Prairie Hills Addition be approved. In celebration of Dr. King’s birthday, the Brookings Human Rights Commission sponsored an essay contest for middle school and high school students to help students reflect on Dr. King’s ideas and their effect on our community through their contest entry. However, any student was encouraged to write on any aspect of Black History should they choose, designed so students can better envelop themselves into the greater history of America. This year’s theme was: “There comes a time when one must take a position that is neither safe, nor politic, nor popular, but he must take it because conscience tells him it is right.” Mayor Keith Corbett will present the awards. This inspires me because I also have a dream that I want to make come true. That dream is to make a difference and help others. As an African American girl, in a mostly all white school in Brookings, South Dakota, there are times, much like Ruby Bridges and Martin Luther King Jr., I need to stand up for myself and what I believe in as well. Some examples are when classmates don’t understand that it is not appropriate to touch my hair, when classmates ask me questions about adoption that are personal and not their business, or when we talk about topics related to black history and they stare at me and make me feel uncomfortable. These moments have taught me that I have to stand up for myself even if it is not popular. I am so glad my parents have taught me to look beyond the tough moments to find the heroes. They are always there. Ruby Bridges and Martin Luther King Jr. were heroes through some of the roughest times in America’s history. They had to make a choice to live by the words “There comes a time when one must take a position that is neither safe, nor politic, nor popular, but he must take it because conscience tells him it is right.” They were heroes, and I hope to be one too. MLK Junior helped us realize, That using your conscience opens up your eyes. It lets you know, You can stand in a position that safety might undergo, Or that others don’t need to agree with you, But if your mind thinks so it might as well be true. So in some tough times, Safety or popularity doesn’t cost you a dime. Nor does a political point of view, Because if your conscience tells you, We can only know that it is right, And stand by that thought with a full heart of delight. 2 An example of following your moral code is that you found out that a company in your city is ignoring applications from minority groups and people of color. While you cannot force the company to change immediately, you could write them a letter explaining that this is immoral and should be stopped. If they do not stop, perhaps you could write a petition to the city council and raise awareness about this issue. While this is not stopping racism altogether, it did make a difference for the many people of color and minority groups in your community. The right thing to do may not be what is popular or safe, but what is necessary and morally correct. Without people like Dr. King, the world would not be how it is today. Segregation would not have ended and many positive things that are linked to the end of segregation would not have happened as well. While we may not be able to change big things, we can speak out against the injustices in our community and advocate for morally right things. Since ours is not a perfect world, there always must be some who are willing to take a stand and dedicate their lives to a just cause like Dr. King just did. Montgomery Bus Boycott, made up of over 17,000 black citizens. About thirteen months later, the Supreme Court enforced the city to desegregate the buses. At the exceptionally tender age of six, Ruby Bridges was the first African American student to join an all-white elementary school in the South. Ruby Bridges was the oldest of five children, born on September 8, 1954. Ruby’s parents, Lucille and Abon Bridges, set their hearts on having their eldest daughter go to school. Ruby took an entrance exam for African American students at William Frantz Elementary School and was one of six students to pass the exam. Gathering up all her courage in her tiny body, she walked alongside her mother and four federal marshals every day to her new school. Still alive to this day, Ruby Bridges Hall, is a civil rights speaker, author, and advocate. Possibly the most commonly known black name, Martin Luther King, Jr. delivered his “I Have a Dream” speech at the March. Washington August 28, 1963, he pleaded for justice for a total of seventeen minutes, Martin Luther King, Jr. spoke of a day that black and white children can play hand in hand; that black and white women can marry and not be judged so. One hundred years before delivering his speech, Negros were, and to that day as well, “sadly crippled by the manacles of segregation and the chains of discrimination.” It is truly shameful of our country that black people are still targeted and judged for the color of their skin. I have a dream, that in this lifetime, racism and modern segregation will cease. The project included full reconstruction to widen the roadway with concrete pavement, new concrete sidewalk and shared-use, replacement of underground utilities, traffic signal upgrades, and new street lighting. The project was designed by Civil Design, Inc. and was constructed by Timmons Construction in 2019. Jason Reaves, Executive Vice President of the SD Chapter of the American Concrete Pavement Association, will present the award to the City of Brookings. The project category for the award is Municipal Streets & Intersections (under 30,000 Square Yards) from their Excellence in Concrete Paving Awards program. Item #4a – The applicant is requesting to rezone from a Business B-2A Office District to a Business B-2 District. These lots are currently occupied by residential properties used for rental purposes. The applicant plans to demolish these structures and rebuild for Commercial Use. There are multiple zones in this area. The Comprehensive Plan does show this area with intended uses as mixed housing types, commercial, office and service uses. James Drew is representing this request on behalf of the applicant. The proposed project is an approximate 2,200 sf , one-story building that will be situatated on a lot of approixmately 24,000 square feet. The building will have architechtural design to be asthetically appealing. The property to the east has fencing, but the proposal does follow the required bufferyard and landscaping, but they will be willing to add additional plantings if necessary. The parking lot will have adequate room to allow for turning and there will not be a need for traffic to back in to 6th Street. Gaylord Woods – 1335 5th Street is concerned about the noise and lighting from vehicles on this property. He is not in favor of this request. Kathy Larsen and her husband Jay have been residents at 1353 5th Street for 40+ years. They are against this rezone request. The B-2A zoning versus the B-2 zoning is significant. She feels that appropriate transition should be made between residential and commercial and the B-2 zoning isn’t a good option for this transition. The lighting that will be installed for this development will be significant and will have a negative impact on them and their property. The traffic increase due to a business being built here is also a concern since the pool and park are so close. Larsen feels that there is a chance for fewer potential problems with the B-2A zoning. Ms Squires lives in this area and she is concerned about the children in this area and their safety. She would like the Commission to consider safety of the neighbors/neighborhood. Struck explained that the parking requirements in this zone will require the building to be quite small. The building is planned to be 18 feet tall which is actually lower than the roof line of the neighboring houses. A resident in the area is concerned that the people living in these houses won’t have a place to go to. Mills asked for clarification on the bufferyard requirements. Struck explained these requirements for the B-2A District between a residential zone and the B-2A. The Committee’s purpose directly corresponds to the City’s goal to provide a high quality of life for its citizens. The Committee has created a three-prong partnership with the Department of Social Services and Independent Living Choices to disseminate collected durable medical equipment and create the most efficient way to direct and help the people of Brookings. The Committee has also created and presented two annual awards, the A.B.L.E. (Ability, Belief Leadership and Equality to Achieve Access for All) Award and EMPOWER Award to local entities who go above and beyond accommodating and employing individuals with disabilities. Members of the committee shall be appointed by the Mayor at the first regular meeting in January of each year, to serve a period of three years, without compensation. In the event a vacancy occurs on a date other than the first Monday of the year, then the vacancy may be filled by appointment for a term not exceeding three years, which term shall expire on the first Monday of January. Financial Consideration: Currently, the estimated 2020 surplus for the General Fund is $3.7M including the COVID federal relief funds received. The CIP fund is currently estimated to end the year with a $3.1M surplus. It is important to note that these are estimates as of today as the City’s Finance Department is working on closing the year and finalizing the Financial Audit. That said, we don’t expect material changes to these estimates. The City Council Financial Policy Projects will reflect these amounts and presented in the near future. Background: South Dakota State University has been leasing this hangar site since 1971. The lease area is 4,800 square feet located on Site 201 at the Brookings Regional Airport. The previous lease was for a 5-year term. The City updated the lease format for a 25-year term for all hangar lease renewals. The 2021 lease rate will be $0.13/square foot which will be increased by 2% annually and subject to review every five years to determine a new percentage increase. Item Details: A public hearing is required as per SDCL 9-12-5.2 to lease to a private person: 9-12-5.2. Powers - Lease to private person - Resolution - Notice - Hearing - Authorization. If the governing body decides to lease any municipally owned property to any private person for a term exceeding one hundred twenty days and for an amount exceeding five hundred dollars annual value it shall adopt a resolution of intent to enter into such lease and fix a time and place for public hearing on the adoption of the resolution. Notice of the hearing shall be published in the official newspaper once, at least ten days prior to the hearing. Following the hearing the governing body may proceed to authorize the lease upon the terms and conditions it determines. The Notice of Public Hearing was published as required. Legal Consideration: An updated lease agreement will be used for the lease, which was approved by the City Attorney. Strategic Plan Consideration: The hangar lease furthers the strategic initiative of maintaining facilities with a sustainable plan, whereby the City receives revenue from the lease to support the airport. Financial Consideration: The City will receive $624.00 in revenue for 2021 which will be increased at 2% per year. The annual increase will be reviewed every five years throughout the lease.
