The Brookings City Council held a meeting on Tuesday, December 15, 2020 at 5:00
PM, at the City & County Government Building Chambers with the following City Council
members present: Mayor Keith Corbett and Council Members Nick Wendell, Holly Tilton
Byrne, Joey Collins, Leah Brink, and Oepke Niemeyer. Absent: Council Member Patty
Bacon. City Attorney Steve Britzman, City Manager Paul Briseno, and City Clerk
Bonnie Foster were also present.
5:00 PM EXECUTIVE SESSION
A motion was made by Council Member Wendell, seconded by Council Member Brink,
to enter into Executive Session at 5:02 p.m., pursuant to SDCL 1-25-2.1 for discussing
the qualifications, competence, performance, character or fitness of any public officer or
employee or prospective public officer or employee. The term, employee, does not
include any independent contractor. The City Manager, City Attorney, and City Council
were present. The motion carried by a unanimous vote. A motion was made by Council
Member Wendell, seconded by Council Member Tilton Byrne, to exit Executive Session
at 5:50 p.m. The motion carried by a unanimous vote.
6:00 PM REGULAR MEETING
Consent Agenda. A motion was made by Mayor Corbett, seconded by Council
Member Wendell, to amend the agenda to include a Proclamation recognizing Dr.
Bonny Specker. The motion carried by the following vote: Yes: 6 - Corbett, Niemeyer,
Brink, Wendell, Tilton Byrne, and Collins; Absent: 1 – Bacon. A motion was made by
Council Member Brink, seconded by Council Member Wendell, to approve the Consent
Agenda as amended. The motion carried by the following vote: Yes: 6 - Corbett,
Niemeyer, Brink, Wendell, Tilton Byrne, and Collins; Absent: 1 – Bacon.
3.A. Action to approve the agenda.

3.C. Action on Resolution 20-110, a Resolution approving Agreements with the
Brookings Regional Humane Society for the Care and Disposition of Impounded
Animals.
Resolution 20-110 - A Resolution Approving Agreements with the Brookings Regional
Humane Society for the Care and Disposition of Impounded Animals
Whereas, the City of Brookings has previously entered into an Agreement with the
Brookings Regional Humane Society for the care and disposition of Impounded
Animals; and
Whereas, the City of Brookings and Brookings Regional Humane Society have agreed
to minor changes to the current Agreement for the Care and Disposition of Impounded
Animals, which amendment would be effective for the remainder of 2020; and
Whereas, the City of Brookings and Brookings Regional Humane Society have also
agreed to the terms of an Agreement for the Care and Disposition of Impounded
Animals, which Agreement would be effective for the calendar year 2021; and
Whereas, this Resolution is intended to authorize the City to enter into both the
Amended Agreement as described herein for the remainder of 2020 and the
above-described Agreement with the Brookings Regional Humane Society for the year
2021.
Now, Therefore, It Is Hereby Resolved by the City Council of the City of Brookings,
South Dakota that the Amended Agreement for 2020 and the Agreement for Care and
Disposition of Impounded Animals for the year 2021 with the Brookings Regional
Humane Society are hereby approved and the City Manager and City Clerk are
authorized to execute these Agreements.
3.D. Action on appointment to the Brookings Committee for People who have
Disabilities. Appoint Kendra Eichten, SDSU ADA Coordinator, as the SDSU Liaison.
Open Forum.
Bradley Walker expressed concerns regarding the City of Brookings December City
Council Meeting schedule, and phases of the COVID-19 Ordinance.
Introduction of new City of Brookings employees. Chief Financial Officer Erick
Rangel introduced Bill Heldt as the new Brookings Municipal Liquor Store Manager.
Presentation: Proclamation. Mayor Corbett read a Proclamation designating
December 15, 2020 as Dr. Bonny Specker Day.

Whereas, the City of Brookings benefits from contributions by individuals who, through
their actions, make our community a better place to live; and
Whereas, one such individual is Epidemiologist Dr. Bonny Specker; and
Whereas, Bonny has been actively involved in COVID-19 pandemic mitigation efforts
through South Dakota State University, Division of Research and Economic
Development; and
Whereas, Bonny has been devoted to providing accurate information through the daily
distribution of data, as well as weekly regional, statewide, national, and worldwide
updates; and
Whereas, Bonny’s efforts have assisted all those making informed decisions; and
Whereas, Bonny’s demonstrated commitment to the greater good of the community and
public health sets an exceptional example of what it means to be an outstanding
resident.
Now, Therefore, I, Keith W. Corbett, Mayor of the City of Brookings, South Dakota, do
hereby proclaim Tuesday, December 15, 2020, as Dr. Bonny Specker Day.
Ordinance 20-029. A motion was made by Council Member Collins, seconded by
Council Member Wendell, that Ordinance 20-029, an Emergency Ordinance Amending
Emergency Ordinance 20-028 to Extend and to Comprehensively Adopt Provisions to
Address a Public Health Crisis and to Revise Certain Measures which are Necessary
for the Immediate Preservation of the Public Health, Safety and Welfare of the City
and are Necessary to Slow the Community Spread of Coronavirus (COVID-19) in
the City of Brookings, South Dakota, be approved. Public Comment: Bonny Specker,
Jason Merkley, President and Chief Executive Officer for Brookings Health System,
Patrick Siegling, Avera Clinic, Amy Hockett, Sanford Clinic, Klint Willert, Superintendent
of Brookings School District, Daniel Scholl, SDSU, Bradley Walker, and Dr. David
Meyer. The motion carried by the following vote: Yes: 4 - Corbett, Niemeyer, Wendell,
and Tilton Byrne; No: 2 – Collins, and Brink; Absent: 1 – Bacon.

Term Loan from the General Fund to the Bob Shelden Capital Project Fund, be
approved. The motion carried by the following vote: Yes: 6 - Corbett, Niemeyer, Brink,
Wendell, Tilton Byrne, and Collins; Absent: 1 – Bacon.
Resolution 20-108 - Resolution Authorizing a Short-Term Loan
from the General Fund to the Bob Shelden Capital Project Fund
Whereas, the Sales Tax Revenue Bond, Series 2019, is the funding source for the Bob
Shelden Capital Project, and
Whereas, the City has determined it can reduce its interest expense for the Bob
Shelden Capital Project expenditures by utilizing unrestricted funds in the General Fund
until April 23, 2021, when the variable interest rate of the 2019 Sales Tax Revenue
Bond will be converted to a fixed rate; and
Whereas, the City desires to finance the Bob Shelden Capital Project expenditures until
the April 23, 2021 Commitment Expiration Date of the above-referenced Revenue Bond
to reduce interest expense using a short-term interfund loan from the General Fund to
the Bob Shelden Capital Projects’ Fund, and
Whereas, in accordance with SDCL 9-22-24, the City is authorized, upon approval of
the City Council, to loan unrestricted cash from one fund to another fund of the City, and
Whereas, it is in the best interests of the City of Brookings to finance expenditures for
the Bob Shelden Capital Project through a short-term loan from the General Fund, with
the short-term loan repaid to the General Fund on April 23, 2021,
Now, Therefore, Be It Resolved, that the City Manager is directed to execute a short-
term Interfund Loan from the General Fund to the Bob Shelden Capital Project Fund,
payable as follows:
Principal $3,033,110.26
Interest 0.0%
Term Dec. 15, 2020 - April 23, 2021 (129 days).
Resolution 20-109. A motion was made by Council Member Brink, seconded by
Council Member Wendell, that Resolution 20-109, a Resolution Transferring City
Manager Contingency Funds to City Departments, be approved. The motion carried by
the following vote: Yes: 6 - Corbett, Niemeyer, Brink, Wendell, Tilton Byrne, and Collins;
Absent: 1 – Bacon.

Whereas, the City of Brookings hereby transfers City Manager’s contingency funds to
fund unplanned operational obligations of the municipality. This resolution is for the
purpose of completing a transfer of contingency funds to the following accounts:

403 City Clerk
101-403-5-422-11 Software Services $ 2,500.00

Whereas, this resolution is deemed necessary for the immediate preservation of the
public peace, health, safety and support of the City, and shall become effective upon

Resolution 20-111. A motion was made by Council Member Brink, seconded by
Council Member Collins, that Resolution 20-111, a Resolution Authorizing Additional
2021 Non-Profit Outside Agency Funding, be approved. The motion carried by the
following vote: Yes: 6 - Corbett, Niemeyer, Brink, Wendell, Tilton Byrne, and Collins;
Absent: 1 – Bacon.

Whereas, the City of Brookings approved 2020 non-profit outside agency funding; and
Whereas, $41,000 was not spent due to COVID-19 circumstances; and
Whereas, the City Council approved $225,486 for 2021 non-profit outside agency
funding; and
Whereas, the 2021 budget for outside agency funding is within the four (4) percent
governance and ends policy; and
Whereas, COVID-19 has created greater funding need throughout the Brookings
non-profit community; and
Whereas, Brookings residents are dependent of non-profit services now more than
ever; and
Now, Therefore, Be It Resolved:
1. The City Council will redistribute $41,000 of 2020 allocated non-profit funding to
the 2021 non-profit need.
2. That the United Way will make recommendation to City Council for the 2021
distribution of $266,486.
City Manager Compensation Package.
A motion was made by Council Member Brink, seconded by Council Member Wendell,
that the 2021 City Manager Compensation Package (3% pay increase / annual salary of
$158,829.58) be approved. Public Comment: Bradley Walker. Yes: 6 - Corbett,
Niemeyer, Brink, Wendell, Tilton Byrne, and Collins; Absent: 1 – Bacon.
Adjourn. A motion was made by Council Member Wendell, seconded by Council
Member Collins, that this meeting be adjourned at 7:19 p.m. The motion carried by a
unanimous vote.

Summary:
Pursuant to SDCL 9-22-6, “Designation of depositories of municipal funds,” the governing body shall
designate the depository or depositories in which the funds belonging to the municipality shall be
deposited. Such depository or depositories shall be a bank or banks within the State of South
Dakota, unless otherwise specifically provided by law.

Summary:
Pursuant to SDCL 9-12-6 “Designation of official newspapers,” each municipality shall designate at a
meeting of its governing body an official newspaper or newspapers for a period of time, not to be less

published in the municipality.

Action on Resolution 21-004, a Resolution Fixing Time and Place for Hearing upon Assessment Roll
for Sidewalk Assessment Project No. 2019-01SWR, 2019 Sidewalk Repair Sites.
Summary:
This resolution will set the public hearing date for Tuesday, January 26, 2021, for the Sidewalk
Assessment Project No. 2019-01SWR, 2019 Sidewalk Repairs Sites.
Background:
This project was the annual concrete project and entailed construction of miscellaneous concrete
work including homeowner missing sidewalk or trip hazards that were not repaired in the 2018
sidewalk area and property owners in the 2019 sidewalk area who volunteered to be on the project.
Resolution 19-043 was adopted on July 9, 2019 and authorized the sidewalk assessment project.
The assessment cost for each property owner is calculated by using their specific sidewalk cost plus
a 6% fee for engineering and administration. This resolution will set the public hearing date for
January 26, 2021 to assess the project. Notices will be mailed to the property owners included in the
assessment.
Fiscal Impact:
The city will collect the sidewalk assessment costs for the trip hazard repairs.
Recommendation:

Resolution 21-004
Resolution Fixing Time and Place for Hearing Upon Assessment Roll for
Sidewalk Assessment Project No. 2019-01SWR, 2019 Sidewalk Repair Sites
Be It Resolved by the City Council of the City of Brookings, South Dakota, as follows:
1. More than twenty days have elapsed since the adoption and publication of
Resolution 19-043, Resolution Determining the Necessity of Repairing or
Installing Sidewalks for Sidewalk Assessment Project No. 2019 -01SWR. The
referendum has not been invoked, and no wr itten protests against the making of
said improvement have been filed with the City Manager.
2. A contract for Sidewalk Assessment Project No. 2019-01SWR has been duly
executed, and the City Council is authorized to levy special assessments
pursuant to the provisions of chapter 9-43, SDCL 1967, as amended.
3. The assessment roll for Sidewalk Assessment Project No. 2019-01SWR was
filed in the office of the City Clerk on the 5th day of January, 2021 and the City
Council shall meet in the Chambers at the City & County Government Center,
520 3rd Street, Brookings, SD on Tuesday, the 26th day of January, 2021, at 6:00
o'clock PM, the said date being not less than twenty (20) days from the filing of
said assessment roll.
4. The assessments shall be on the basis of benef its upon each lot or tract of land
contiguous to the sidewalk constituting said improvement. The assessment shall
be divided into five (5) equal annual installments for all amounts over $300.00.
For amounts of $300.00 or less, the entire assessment shall be due. The
interest rate to be borne by the unpaid installments of the special assessment is
ten percent (10%).
5. Unless paid to the City in advance of maturity, the assessments shall be
collected by the City Manager in accordance with the procedure for Plan One in
Chapter 9-43, SDCL 1967, as amended.
6. The City Clerk is authorized and directed to publish notice in the official
newspaper at least one week prior to the date set for hearing and to mail a copy
thereof, by first class mail addressed to the owner or owners of any property to
be assessed for the improvement at the address shown by the records of the
Director of Equalization not less than ten nor more than twenty days prior to the
hearing.

Summary:
This resolution will set the public hearing date for Tuesday, January 26, 2021, for the Sidewalk
Assessment Project No. 2020-01SWR, 2020 Sidewalk Repair Sites.
Background:
This project was the annual concrete project and entailed construction of miscellaneous concrete
work including homeowner missing sidewalk or trip hazards that were not repaired in the 2019
sidewalk area and property owners in the 2020 sidewalk area who volunteered to be on the project.
Resolution 20-052 was adopted on June 9, 2020 and authorized the sidewalk assessment project.
The assessment cost for each property owner is calculated by using their specific sidewalk cost plus
a 6% fee for engineering and administration. This resolution will set the public hearing date for
January 26, 2021 to assess the project. The City Engineering Department will mail notices to the
property owners included in the assessment.
Fiscal Impact:
The city will collect the sidewalk assessment costs for the trip hazard repairs.
Recommendation:
Staff recommends approval.

Resolution 21-005
Resolution Fixing Time and Place for Hearing Upon Assessment Roll for
Sidewalk Assessment Project No. 2020-01SWR, 2020 Sidewalk Repair Sites
Be It Resolved by the City Council of the City of Brookings, South Dakota, as follows:
1. More than twenty days have elapsed since the adoption and publication of
Resolution 20-052, Resolution Determining the Necessity of Repairing or
Installing Sidewalks for Sidewalk Assessment Project No. 20 20-01SWR. The
referendum has not been invoked, and no wr itten protests against the making of
said improvement have been filed with the City Manager.
2. A contract for Sidewalk Assessment Project No. 2020-01SWR has been duly
executed, and the City Council is authorized to levy special assessments
pursuant to the provisions of chapter 9-43, SDCL 1967, as amended.
3. The assessment roll for Sidewalk Assessment Project No. 2020-01SWR was
filed in the office of the City Clerk on the 5th day of January, 2021 and the City
Council shall meet in the Chambers at the City & County Government Center,
520 3rd Street, Brookings, SD on Tuesday, the 26th day of January, 2021, at 6:00
o'clock PM, the said date being not less than twenty (20) days from the filing of
said assessment roll.
4. The assessments shall be on the basis of benef its upon each lot or tract of land
contiguous to the sidewalk constituting said improvement. The assessment shall
be divided into five (5) equal annual installments for all amounts over $300.00.
For amounts of $300.00 or less, the entire assessment shall be due. The
interest rate to be borne by the unpaid installments of the special assessment is
ten percent (10%).
5. Unless paid to the City in advance of maturity, the assessments shall be
collected by the City Manager in accordance with the procedure for P lan One in
Chapter 9-43, SDCL 1967, as amended.
6. The City Clerk is authorized and directed to publish notice in the official
newspaper at least one week prior to the date set for hearing and to mail a copy
thereof, by first class mail addressed to the owner or owners of any property to
be assessed for the improvement at the address shown by the records of the
Director of Equalization not less than ten nor more than twenty days prior to the
hearing.

Summary:

The project is completed and ready to be closed out. The final cost of the project is $3,347,418.19,
which is an increase of $61,177.49 from the current contract amount. The change order increase was
primarily due to additional excavation, trench material and gravel needed to stabilize the subgrade
and for maintenance of the detour routes.

Summary:
This resolution will approve Change Order No. 2 (Final) for the 2019-03SSI 20th Street
South Construction Project to adjust bid quantities to final as-constructed quantities for
an increase of $61,177.49 to the contract to close out the project.
Background:
This project was the reconstruction of 20th Street South from Main Avenue South to Rio
Grande Avenue, which included storm sewer, water main, sanitary sewer, grading, curb
& gutter, asphalt paving and a new 8’-wide concrete shared use path along the south
side of the street. The project was phased over the two-year period of 2019 and 2020.
Item Details:
This project has been completed and is ready to be closed out. There will be a warranty
inspection in the spring of 2021 to view the seeding, topsoil, and any other issues which
may need to be addressed by the contractor. The change order increase was primarily
due to additional excavation, trench material, and gravel to stabilize the subgrade and
for maintenance of the detour routes.
The change order summary is as follows:
Original Contract Price: $3,241,110.70
Increase from Previously Approved Change Order (No. 1): $ 45,130.00
Contract Price Prior to this Change Order: $3,286,240.70
Increase of this Change Order (No. 2 Final): $ 61,177.49

Legal Consideration:
SDCL 5-18B-19 allows for a change order up to $250,000 for this size of contract. The
change order proposed is within the change order limit allowed by statute.
Strategic Plan Consideration:
This change order will aid in the longevity of the trench areas and subgrade, thereby
protecting the City’s investment.
Financial Consideration:
The contract will increase by $61,177.49 which will be funded by the project budget.

Public Hearing and Action on Ordinance 20-025, an Ordinance rezoning 22 acres from a Residence
R1-B single family district to R-3 apartment district (generally located south of 20th St. So. and West
of Valley View Addition).
Summary:
Blairhill Properties, Inc., has submitted a petition to rezone 22 acres of land from R1-B to R-3. The
rezoning request is related to and a prerequisite for the preliminary plat of River Run Addition which
was applied for simultaneously.
Background:
The applicant is requesting a rezone for 22 acres of land generally located south of W 20th Street So.
and west of Valley View Addition. The parcel is currently zoned R-1B Single-family district. The
applicant is requesting an R-3 apartment district.
The applicant wishes to submit a preliminary plat for 85 single-family lots, some with lot sizes smaller
than the minimum lot area of 10,000 sq. ft. required for an R-1B. Additionally, multiple lots in their
proposal call for zero setback, shared-wall, units. The minimum side yard for a two-family unit is R1-B
is 8 feet. R-3 allows for 0 feet setback for 2 units with a shared common wall.
The comprehensive plan calls for Medium Density Residential (MDR) land use in this location. The
MDR land use designation allows for R1-B, R1-C, R1-D, R-2, and RMH. MDR also suggests a land
use intensity of 4 - 12 units per acre. The proposed plat calls for 85 units on 22 acres, a land use
intensity of 3.86 units per acre. Although the R-3 zoning district is not specifically called out in the
allowable zones in the MDR land use category, this proposal would still match a similar land use
intensity set forth by the comprehensive plan.
Adjacent zoning includes R1-B and R-3 for Valley View Addition to the east, Joint-Jurisdiction
Agriculture (JJ-A) to the south and southwest, and Agriculture (A) and JJ-A to the northwest.
Recommendation:
The planning commission voted 7-0 recommending approval of the rezoning request.
The Development Review Team (DRT) and staff recommend approval of the rezoning request.

Be It Ordained by the City of Brookings, South Dakota:
Section 1. That the real estate situated in the City of Brookings, County of Brookings, State
of South Dakota, described as follows, to-wit:
West 755 feet of North ½ of Northeast ¼ in Section 3, Township 109 North, Range
50 West (Generally located South of W 20th Street South and West of Valley View

In accordance with Section 94-7 of Article I of the Code of Ordinances of Brookings, South

Acting Chairperson Eric Rasmussen called the meeting of the City Planning Commission to
order on Tuesday December 1, 2020, at 5:30 PM in the Council Chambers Room #310 on the
third floor of the City & County Government Center. Members present were Tanner Aiken – via
telephone, Ashley Biggar, James Drew, Jason Meusburger, Jacob Mills, Lee Ann Pierce, and
Rasmussen. Absent were Greg Fargen and Gregg Jorgenson. Also present were Community
Development Director Mike Struck, City Planner Ryan Miller, City Engineer Jackie Lanning,
Keith and Cathy Rounds, Brookings Area Habitat for Humanity- Dan McColley, Banner

Official Summary
Item #5a – The applicant is requesting a rezone for 22 acres of land from R-1B Single-family to
R-3 Apartment District. This land is located south of W 20th Street S and west of Valley View
Addition. The Comprehensive Plan does designate this area as a medium density residential
development. A single family district is what is being proposed by the upcoming preliminary
plat. This preliminary plat is for 85 single-family lots, some with lot sizes smaller than the
minimum lot area of 10,000 sf for an R1-B zoning. The lots along the east side of the
development will be single-family attached, zero foot side yard homes which are allowed in the
R-3 zoning district. The intention for this development is to be single family. Struck ex plained
that there are advantages to the lot area and setback requirements in the R-3 district to allow for
the zero foot side yard homes.
Keith Rounds, owner of Blairhill Properties Inc, explained that having this land rezoned to R-3
will allow them to best utilize this land and to allow them to build the twin homes. They have no
desire and will not allow any apartments to be built on these lots. They developed Valley View
with the intent of providing available housing and that is the plan with this development.
Dan McColley, Executive Director of Brookings Area Habitat for Humanity, is in favor of this
request. Developments like this are what Habitat needs for their program. This size of lots will
allow for minimum income families to succeed with building their own home that will be
affordable.
Struck explained that City Staff has fielded several calls regarding this request. The notice that
was published and mailed to surrounding property owners is a little deceiving as it states “R-3
Apartment District” which is the official name of that zoning district.
Resident from 2202 Rio Grand is concerned about the timing of the notice that he received.
Struck explained that the notice being mailed is a courtesy and not a requirement and staff
followed publication requirements.
Jeff Struwe – 2004 Rio Grand – explained that to the west of him is a creek that runs to Valley
View. He is wondering about the drainage in the northeast corner. Rasmussen explained to him
that part of the process during preliminary platting is a drainage study and that will be required.
Justin Bucher with Banner Associates has been working on the development of this area. They
are currently working on the drainage plan and it will be submitted to the City for approval.
They have planned detention facilities to help with the drainage in this area. Pierce asked what
this detention facility will look like. Bucher explained that it will be a pond with a berm around
it. Water will leave through a culvert under 20th Street South.
Janessa Retzer, 2020 Rio Grand explained that when they purchased their homes in Valley View
that there wouldn’t be a development to the west of them because of the drainage ditch that was
there. Valley View is very family oriented and she is wondering if this new development is
going to have the same feel as Valley View. If the development is going to be different from
their neighborhood, then maybe a fence could be put up to distinguish their neighborhood from
this new one. She also stated that behind their house they have issues with water and flooding
anytime it rains.
Jessica Koelln, 2016 Rio Grande, explained that they purchased their house in Valley View
because they wouldn’t have neighbors in their backyard to the west. There is a drainage ditch in
their backyard that was supposed to prevent close neighbors. She is wondering if this new
neighborhood will have covenant requirements. She too is concerned about the drainage and
how this will work. She would like to see if some other verbiage could be used to prevent any
apartments being built. Struck explained that the Residence R1-D district is similar but using
this district will result in losing housing units. When this happens, then each lot then becomes
more expensive.

Blairhill Properties, Inc., has submitted a preliminary plat for River Run Addition. River Run Addition
will include 85 single-family lots and two outlots on a 22-acre piece of property located generally
South of 20th Street South and West of Valley View addition.
The subdivision includes the following blocks:
Block 1 - featuring 7 traditional single unit lots and 20 zero-setback lots designed for individually
owned twin-home units with shared common walls. 27 lots total.
Block 2 - featuring 2 single family lots.
Block 3 - featuring 20 single family lots and two outlots for drainage.
Block 4 - featuring 7 single unit lots and 6 zero-setback lots designed for individually owned twin-
home units with shared common walls. 13 lots total.
Block 5 - featuring 12 single family lots.
Block 6 - featuring 11 single family lots.
The property is currently zoned R1-B and will require a rezoning to R-3 in order to satisfy the
proposed single-family attached zero-foot side yard units as well as the minimum lot area for many of
the lots. Lots 10-26, Block 1 and Lots 2-6, Block 4 would not meet the minimum lot requirement for
single-family units; however, these lots are being designed for twin-units with zero setback, and
shared common wall structures. Therefore, when combing the lots for each half of the twin-unit, the
minimum lot area requirement is met. The units per acre intensity proposed is consistent with the
comprehensive plan.
Primary access for the subdivision will come off 20th Street South with secondary access coming
from the East at Rapid Valley Street. Circulation will be provided by an additional north-south street
and three east-west streets within the subdivision. One of the two north-south streets may serve as a
collector street for future growth to the south as noted in the future street map within the
comprehensive plan. All streets will be public.

street in the area to serve future growth to the south, access to utilities, and the need for
a preliminary drainage plan prior to final approval of the preliminary plat.
Findings of Fact:
1. Lot dimensions conform to R-3 standards.
2. Block standards are met.
3. Secondary access is provided.
4. Units per acre density conforms to the comprehensive plan.
5. Upon receipt of a preliminary drainage plan, all required data is included.
Item Details:
The River Run preliminary plat is consistent with the Comprehensive Plan’s Future Land
Use Intensity as the proposed development consists of 3.86 units per acre, below the
recommended Medium Residential Density of 4 – 12 units per acre.

Acting Chairperson Eric Rasmussen called the meeting of the City Planning Commission to order on
Tuesday December 1, 2020, at 5:30 PM in the Council Chambers Room #310 on the third floor of the
City & County Government Center. Members present were Tanner Aiken – via telephone, Ashley
Biggar, James Drew, Jason Meusburger, Jacob Mills, Lee Ann Pierce, and Rasmussen. Absent were
Greg Fargen and Gregg Jorgenson. Also present were Community Development Director Mike Struck,
City Planner Ryan Miller, City Engineer Jackie Lanning, Keith and Cathy Rounds, Brookings Area

OFFICIAL SUMMARY
Item #6a – This preliminary plat is predominantly for residential lots. The planned street
connectivity works well. A drainage plan will be required and the preliminary plat will not move
forward until an approved drainage plan has been approved by City staff.
Cathy Rounds explained that there will be covenants and restrictions and these will have rules about
what can be built in this development and there will be architectural review implemented. He stated
that they will not allow for any apartments to be built. Drew wanted to clarify that the intent of this
development is for single-family and duplexes, not tri-plex’s or larger. Rounds stated that this is
accurate.
Mills was wondering if this development would be getting done in phases and if sidewalks would be
required to allow for pedestrian traffic. Struck explained that the 10 foot shared use path was stopped
from going any further west until development to the west is complete. Mills wondered if there were
TIF funds available to help with the installation of sidewalk to provide pedestrian access. Struck stated
that they will know this once the current 20th Street South project is complete with final payments.
Mills wondered if they could require the developer to install sidewalk.

Summary:
A conditional use permit application has been submitted for the establishment of a major home
occupation at 1420 Legeros Dr. The home occupation will consist of the operation of a CNC machine
and 3-D printer within a single-family home.
Background:
Alexander Schafer, homeowner of 1420 Legeros Dr., has submitted a conditional use permit
application for a major home occupation proposed within his home. The home and surrounding lots
are located within a Residence R1-C single-family district. Major home occupations require a CUP
within this zoning district.
The intended use is the operation of a personal CNC machine and 3-D printer within the home for the
homeowner’s business making custom maid-to-order parts and accessories. The operation is
anticipated to use more than 500 sq. ft. but no more than 50% of the gross floor area of one story of
the home. The amount of space utilized for the home occupation as well as the existence of
mechanical equipment necessitates the requirement for major home occupation rather than a minor
home occupation.
The applicant does not anticipate noticeable on-site sales or traffic increases.
Recommendation:
The Planning Commission voted 7-0 recommending approval of the Conditional Use Permit. Staff
recommended approval of the conditional use permit for major home occupation at 1420 Legeros Dr.

Summary:

The proposed use did not meet the requirements for a minor home occupation,
therefore, a major home occupation is required. A major home occupation is allowed in
the R1-C district as a conditional use. The proposed use meets the requirements for
major home occupation and CUP.

The proposed use would be an example of a small business start -up promoted in the
strategic plan under fostering culture of innovation and entrepreneurship. An approved
conditional use permit will allow an entrepreneur to start a business in their home with
the hope that the business one day grows to a point of needing relocation into an
industrial center in town.
Options and Recommendation:
The City Council has the following options:
1. Approve as presented
2. Approve with conditions
3. Deny
4. Move the item to a study session
5. Do nothing

Acting Chairperson Eric Rasmussen called the meeting of the City Planning Commission to
order on Tuesday December 1, 2020, at 5:30 PM in the Council Chambers Room #310 on the
third floor of the City & County Government Center. Members present were Tanner Aiken – via
telephone, Ashley Biggar, James Drew, Jason Meusburger, Jacob Mills, Lee Ann Pierce, and
Rasmussen. Absent were Greg Fargen and Gregg Jorgenson. Also present were Community
Development Director Mike Struck, City Planner Ryan Miller, City Engineer Jackie Lanning,
Keith and Cathy Rounds, Brookings Area Habitat for Humanity- Dan McColley, Banner
Associates – Justin Bucher, Resident from 2202 Rio Grand, Jeff Struwe, Janessa Retzer, and
Jessica Koelln.
Item #4a – Alex Schafer has submitted an application for a Conditional Use Permit on Lot 5,
Block 3, Legeros 2nd Addition, also known as 1420 Legeros Drive. The request is to operate a
CNC Machine Shop within a single-family home, which is a major home occupation in the R-1C
District.

OFFICIAL SUMMARY
Item #4a – Miller explained that the applicant would like to operate a CNC machine and 3-D
printer within a single-family home. A conditional use permit is required to operate this major
home occupation out of the residence. Due to the amount of square footage being occupied by
this business and the machine that will be used, this does qualify as a major home occupation.

Summary:
This resolution provides for the execution of a promissory note between the Friends of Baseball
organization and the City of Brookings. The promissory note formalizes the letter of financial
commitment provided to the City by the Friends of Baseball related to the payment for the synthetic
field infield turf installed during the Bob Shelden Ballfield Complex Revitalization project.
Background:
As a part of the Bob Shelden Ballfield Complex Revitalization project the Friends of Baseball
organization agreed to fund the installation and ongoing replacement of the synthetic field turf in the
infield of Bob Shelden Field. The price of the field turf alternate within the project bid documents was
$223,000. Prior to the beginning of the project Friends of Baseball provided a letter of financial
commitment to the City for the amount of the cost of the turf.
Recommendation:
Staff recommends approval.

This resolution provides for the execution of a promissory note between the Friends of
Baseball organization and the City of Brookings. The promissory note formalizes the
letter of financial commitment provided to the City by the Friends of Baseball related to

of Brookings Baseball, Inc., has agreed to reimburse the City of Brookings the sum of
$233,000 Dollars for the partial costs of installation of th is field turf, and
Whereas, this Agreement for cost sharing of the field turf furthers the recreational and
economic development of the City of Brookings, and is therefore authorized pursuant to
South Dakota Codified Laws, Chapter 9-54 and acts amendatory thereto, and
Whereas, the City hereby accepts a loan agreement from Friends of Brookings
Baseball, Inc., whereby Friends of Brookings Baseball, Inc., has agreed to reimburse
the City of Brookings the principal sum of $233,000 Dollars for the partial cost of
installation of field turf at Bob Shelden Field on or by June 1, 2021,
Now, Therefore, Be It Resolved by the City of Brookings that the City hereby approves a
Loan Agreement with Friends of Brookings Baseball, Inc., consistent with the terms of
this Resolution for the reimbursement of the partial costs of installation of field turf at
Bob Shelden Field.

PROMISSORY NOTE
FRIENDS OF BROOKINGS BASEBALL, INC.

For value received, the undersigned, Friends of Brookings Baseball, Inc., (“Borrower”)
promises to pay to the order of the City of Brookings, (referred to as the “City” or “Lender”),
the principal sum of $233,000.00, due in full on or by June 1, 2021.
All payments under this Promissory Note shall be payable at the principal office of the
City, in Brookings, South Dakota. This Promissory Note is issued pursuant to
authorization by the City Council for economic development purposes pursuant to South
Dakota Codified Laws, Chapter 9-54 and any acts amendatory thereto.
This is a non-interest bearing, unsecured note. The Borrower may prepay this Promissory
Note at any time.
In the event of default in the payment of this Promissory Note and if the same is collected by
an attorney, the Borrower agrees to pay all costs of collection, including a reasonable
attorneys’ fee. Past-due payments of principal shall bear interest at the rate of 10% per
annum until paid. Interest shall be calculated on the basis of a year of 365 days.
The Borrower hereby waives presentment for payment, demand, protest, notice of protest
and notice of dishonor.
This Promissory Note is to be construed according to the laws of the State of South
Dakota.
