HomeMy WebLinkAboutBOAMinutes_2018_09_20Board of Adjustment Brookings, South Dakota September 20, 2018 OFFICIAL MINUTES Chairperson George Houtman called the Board of Adjustment meeting to order on Thursday, September 20, 2018, at 5:00 PM in the Chambers Room of the City & County Government Center. Members present were Teresa Binkley, Justin Borns, Dustin Edmison, and Houtman. Absent were Nick Schmeichel and Jeremy Scott. Others present were City Planner Staci Bungard, Michael Foster, Terry Wieczorek, and others. Item #2 — (Binkley/Borns) Motion to approve the agenda. All present voted aye. MOTION CARRIED. Item #3 — (Edmison/Binkley) Motion to approve the September 6, 2018 minutes. All present voted aye. MOTION CARRIED. Item #4a — Hillari & Michael Foster have made a request for a variance on Lot 13, Block 5, Esther Heights Addition, also known as 2230 Rhonda Road. The request is for a wider residential driveway than the maximum allowable width of 36 feet. (Binkley/Borns) Motion to approve the variance request. (Houtman/Binkley) Amendment to the original motion to have the driveway come straight back, from the current curb cut, to the front yard setback line and remove any concrete to the east and re-establish vegetation. All present voted aye. AMENDMENT CARRIED. Motion as amended was voted on. All present voted aye. MOTION CARRIED. (Binkley/Borns) Motion to approve the rear yard setback variance. All present voted aye. MOTION CARRIED. Item #4b — Brickwood Enterprises Inc has made a request for a variance on Sublot 2 of Lot "B", Block 1, Bane and Poole Addition and the W71.5 feet of vacated alley extending from State Street into Block 1, Bane and Poole Addition, also known as 1800 6th Street. The request is for a 0.2 foot front yard encroachment for a building and a 0.9 foot front yard encroachment for another building. (Binkley/Edmison) Motion to approve the variance request. All present voted aye. MOTION CARRIED. Members present were Teresa Binkley, Justin Borns, Dustin Edmison, and Houtman. Absent were Nick Schmeichel and Jeremy Scott. Others present were City Planner Staci Bungard, Michael Foster, Terry Wieczorek, and others. Items #4a — Michael Foster explained that if they removed a section of concrete to get them to a 36 foot width, the detached garage would not be easily accessible. They would be willing to remove the 10' flare on the side of the garage. Also, the Fosters' were not aware of the rear yard setback encroachment. Houtman asked about the detached garage that is extending over the property line. Mr. Foster explained that this is just an overhang on the garage. Houtman asked if they would be willing to bring the current driveway straight back, to the front yard setback, and remove any concrete east of this line. Foster agreed to this, but would like a city official to come out and mark exactly where that front yard setback line is at. Item #41b — Terry Wieczorek, legal counsel for the applicants, explained that the owners are in the process of selling Brickwood Plaza and the purchasers had recently had the property surveyed. The survey showed the buildings are encroaching slightly into the setbacks. The property was surveyed before the buildings were built, so they are not sure why the buildings are encroaching into the setbacks. However, to assist with the process of the sale, the sellers have applied for a variance to allow the buildings to be in the setback area.
