OFFICIAL MINUTES
Chairperson George Houtman called the Board of Adjustment meeting to order on Thursday,
September 6, 2018, at 5:00 PM in the Chambers Room of the City & County Government
Center. Members present were Teresa Binkley, Justin Borns, Dustin Edmison, Nick
Schmeichel, and Houtman. Absent was Jeremy Scott. Others present were City Planner
Staci Bungard, Shawn Knapp, Paul Moriarty, Dorothy Ishol, Rainer Westall, and others.
Item #2 — (Schmeichel/Borns) Motion to approve the agenda.
(Binkley/Schmeichel) Amendment to the motion to include Item #4b — Westall variance
request. All present voted aye. AMENDMENT CARRIED.
Motion as amended was voted on. All present voted aye. MOTION CARRIED.
Item #3 — (Binkley/Edmison) Motion to approve the August 16, 2018 minutes. All present
voted aye. MOTION CARRIED.
Item #4a --Paul Moriarty Living Trust has made a request for a variance on the West 55' of
Lot 15, Block 2 and East 50' of Lot 14, Block 2, Henry's Addition also known as 219 & 221 7 t
Street. The request is for the minimum lot width to construct four (4) single-family attached
units. The property has 105 feet of frontage and the ordinance requires 120 feet.
(Binkley/Borns) Motion to approve the variance request. All present voted no. MOTION
FAILED.
Item #4b — Rainer Westall made a request for a variance on N84' of S184' of O.L. 'C' in
NW1/4 of NW1/4 of Section 2-T109N-R50W, also known as 2011 Western Avenue South.
The request is to build an attached garage five (5) feet from the side property line. The
required setback in the R-3 District is 7 feet.
(Binkley/Edmison) Motion to reconsider the request from the August 16, 2018 Board of
Adjustment meeting. Houtman voted no. All others voted yes. MOTION CARRIED.
(Houtman/Schmeichel) Motion to table to the October 4, 2018 Board of Adjustment meeting.
All present voted aye. MOTION CARRIED.
The meeting was adjourned at 6:50 p.m.

Chairperson George Houtman called the Board of Adjustment meeting to order on Thursday,
September 6, 2018, at 5:00 PM in the Chambers Room of the City & County Government
Center. Members present were Teresa Binkley, Justin Borns, Dustin Edmison, Nick
Schmeichel, and Houtman. Absent was Jeremy Scott. Others present were City Planner
Staci Bungard, Shawn Knapp, Paul Moriarty, Dorothy Ishol, Rainer Westall, and others.
Items #4a — Shawn Knapp explained that he and Paul Moriarty would like to build 4 attached
units on this property. They meet all the requirements other than the lot frontage. The
building will sit sideways on the property as they are trying to maximize the buildable area.
Houtman wondered what the hardship was, Knapp stated the lot size. Bungard stated that
the recently implemented Comprehensive Plan states that a site should compliment the
surrounding area. Binkley wondered how a unit like this meets off-street parking. Bungard
explained that these are single family units, that will be seperate units, so only two spots will
be required. Knapp feels that there is sufficient parking because of the garages and also the
parking that will be availabe in front of the building along 7th Street. Binkley asked if 3 units
could be built instead? Knapp explained that they feel a 4 unit makes more sense.
Dorothy Ishol, who owns 222 8th Street, feels that the alley will not work well for traffic from
this complex, especially in the winter. A 4 unit complex is just too large, but 3 would be fitting
and work nicely. Ishol wondered if these units would be low income. Knapp stated that the
intent isn't to provide low income housing. Paul Moriarty stated that the plan is to provide
downtown living with garages available.
Item #4b — Binkley explained that she would like this topic brought back for consideration due
to the low number of boards members in attendance at the previous meeting. She feels that
it would only be fair to the applicant to have the opportunity to have the request heard in front
of the board with more members is attendance. She also feels that this item should be tabled
to a future meeting to allow the city to advertise the request and notify the surrounding
property owners.
The meeting was adjourned at 6:50 p.m.
