OFFICIAL MINUTES
Vice -Chairperson Justin Borns called the Board of Adjustment meeting to order on Thursday,
August 16, 2018, at 5:00 PM in the Chambers Room of the City & County Government
Center. Members present were Teresa Binkley, Dustin Edmison, Jeremy Scott, and Borns.
Absent were George Houtman and Nick Schmeichel. Others present were City Planner Staci
Bungard, Paul Moriarty, Cindy Ostlie, Rainer Westall, Alan Rogers and Kent Liebel.
Item #2 — (Binkley/Edmison) Motion to approve the agenda with the removal of item #4a. All
present voted aye. MOTION CARRIED.
Item #3 — (Scott/Binkley) Motion to approve the August 2, 2018 minutes. All present voted
aye. MOTION CARRIED.
Item #5a — John W Moriarty Living Trust has made a request for a variance on Lots 9 & 10,
Block 1, Hillcrest Addition, also known as 1451-1457 6th Street. The first request is to pave
the required five (5) foot side yard landscape area. The second request is to pave a portion
of the required ten (10) foot landscape area along 6th Street. The third request is an
exemption from the tree plantings required by the ordinance.
(Binkley/Edmison) Motion to approve the variance request.
(Scott/Binkley) Amendment to the motion that the green space in the NW corner of the
parking lot remain as grass and the additional landscape strip along 6th Street still be
required. Borns and Edmison voted no. Binkley and Scott voted yes. AMENDMENT
FAILED.
Original motion was voted on. All present voted aye. MOTION CARRIED.
Item #51b — Rainer Westall made a request for a variance on N84' of S184' of O.L. 'C' in
NW1/4 of NW1/4 of Section 2-T109N-R50W, also known as 2011 Western Avenue South.
The request is to build an attached garage five (5) feet from the side property line. The
required setback in the R-3 District is 7 feet.
(Binkley/Scott) Motion to approve the variance request. Binkley voted no. Borns, Edmison
and Scott voted yes. MOTION FAILED.
Item #5c — Agri -Cultures Inc has made a request for a variance on Lots 2 & S30' of Lot 1,
Block 5, Bidco Addition, also known as 214 West 2nd Street South. The request is for one (1)
additional 20 square foot freestanding sign, in addition to three (3) existing signs. The
ordinance allows two (2) freestanding signs in the B-3 District.
(Edmison/Scott) Motion to approve the variance request. All present voted aye. MOTION
CARRIED.
The meeting was adjourned at 5:43 p.m.

OFFICIAL SUMMARY
Vice -Chairperson Justin Borns called the Board of Adjustment meeting to order on Thursday,
August 16, 2018, at 5:00 PM in the Chambers Room of the City & County Government
Center. Members present were Teresa Binkley, Dustin Edmison, Jeremy Scott, and Borns.
Absent were George Houtman and Nick Schmeichel. Others present were City Planner Staci
Bungard, Paul Moriarty, Rainer Westall, Alan Rogers and Kent Liebel.
Items #5a — Paul Moriarty, representing the estate of John Moriarty, explained that they are
pouring concrete and replacing the current asphalt in their parking lot. He would like to keep
the current parking spaces and layout, but to do this, he will need a variance to eliminate the
landscaping and tree planting requirements. The current green space in the NW corner of
the lot will remain "no parking', but they would like to make it concrete. Borns wondered what
type of landscaping they plan to do along 6th Street in the landscape strip. Moriarty stated
they will just plant grass there. Bungard stated that ideally, staff would like the green space
in the NW corner to remain grass to help with drainage. Cindy Ostlie, 1454 7th St, is
wondering if this project will affect the drainage in their neighborhood. Bungard stated that
the owner is actually adding some green space and removing some, but the drainage off of
this lot shouldn't change much. Scott would like to see the green space in the NW corner
remain as grass, in addition to the 10 foot landscape strip along 6th Street.
Items #5b — Westall explained that they have a current garage and they would like to move
this garage back and build a new garage/addition to the house. They would like to build the
garage 5 feet from the side property line. Binkley and Borns wondered if the garage/addition
could be built 2 feet smaller so to allow for the proper setback. Westall stated that they could,
but then the garage doors would have to be smaller or one large door. Borns read a letter
which was received from the Triplett's, neighbors at 2019 Western Ave S, and they are not in
favor of this request. They feel that this will affect the resale of their property if this building is
close and it will decrease their property values.
Items #5c — Al Rogers and Kent Leibel acquired this property to develop a "Trades Mall."
They have a new tenant coming in and they would like to have a sign. Bungard explained
that the number of signs allowed is determined by the lot frontage. Binkley asked if the
applicants are currently out of compliance? Bungard said, "Yes and this may have been
caused by the recent changes in the land and they no longer have frontage on Western Ave
as the City owns a parcel abutting Western Ave", according to zoning. Liebel said he has
spoken with surrounding property owners and they are ok with this additional sign. Borns
feels that there is adequate green space so he doesn't feel that there is a problem with this
request.
The meeting was adjourned at 5:43 p.m.
