HomeMy WebLinkAboutBOAMinutes_2019_02_21Board of Adjustment Brookings, South Dakota February 21, 2019 OFFICIAL MINUTES Vice -Chairperson Justin Borns called the Board of Adjustment meeting to order on Thursday, February 21, 2019, at 5:00 PM in the Chambers Room of the City & County Government Center. Members present were Travis Bortnem, Dustin Edmison, Doug Metcalf, Jeremy Scott, and Borns. Houtman and Schmeichel were absent. Others present were City Planner Staci Bungard, Robert Geary, David Jacobson, and others. Item #2 — (Scott/Edmison) Motion to approve the agenda. All present voted aye. Item #3 — (Edmison/Scott) Motion to approve the December 20, 2018 minutes. All present voted aye. MOTION CARRIED. Item #4a — Dr. Clark Sexton made a request for a variance on the North 42.7 Feet of Lots 8 & 9, Block 1, Skinner's Second Addition, also known as 512 7th Avenue. The request is to establish a two-family dwelling on a 4,300 square foot lot with a frontage of 43 feet in an R-2 District. The ordinance requires a lot size of 9,900 square feet with a minimum of 65 foot lot width. Subsequent variances for the rear yard greenspace requirement and parking requirements are also being requested. The ordinance requires 50% of the rear yard to be maintained in living ground cover. (Edmison/Scott) Motion to table to the March 7th meeting. All present voted aye. MOTION CARRIED. Items #4b — David Jacobson made a request for a variance on E158' of Outlot 12, NE'/4 Section 35-Tl10N-R50W, also known as 422 8th Street South. The first request is to construct an addition 20 feet into the 50 foot landscaped buffer area that is required between a B-3 District and a residential district. The second request is to eliminate the required five (5) foot side yard landscape area. (Edmison/Scott) Motion to approve the first variance request. Scott, Borns and Metcalf voted yes. Bortnem and Edmison voted no. MOTION FAILED. Item #5a — Review and Approval of the 2018 Board of Adjustment Annual Report. (Edmison/Scott) Motion to approve the 2018 Board of Adjustment Annual Report. All present voted aye. MOTION CARRIED. Members present were Travis Bortnem, Dustin Edmison, Doug Metcalf, Jeremy Scott, and Borns. Houtman and Schmeichel were absent. Others present were City Planner Staci Bungard, Robert Geary, David Jacobson, and others Items #4a — Due to a lack of proper notification to surrounding property owners, this item is being tabled to the March 7th BOA meeting to provide adequate and accurate notification. Item #4b — David Jacobson, owner of Bobcat of Brookings, explained that their business has expanded and they have a need for extra shop space. The original plan that he submitted was a 40'x60' addition, but they measured and now realize that they have extra space. They would like to build a 50'x60' addition and they would still have a 30 foot buffer between them and the mobile home park to the east. His second request is to eliminate the required 5 foot side yard landscape area. He explained that this lot is not feasible for green space due to the clay ground. They have a fence installed along the east property line which is a good visual buffer, but he doesn't feel that there is space available for a green space strip. Due to the traffic for their business, customers, fuel trucks, and suppliers, he doesn't feel it would be feasible to have this landscape buffer along the east property line. Additionally, the parking lot is asphalted all the way to the property lines on the north and west sides. Borns is concerned about exactly where the property lines are located. He wondered if a drawing could be required to show the property line and measurements. Bortnem ask how far to the east the addition would go? Will it be in line with the other buildings along the property line? Jacobson stated it will be 10' closer to the property line. Borns asked what the setback should be. Bungard explained that it is a 50' setback between a B-3 District and a residential district, but the applicant is looking to build 20' into the required setback/buffer. Also, the applicant would like to forego the required landscape strip. Edmison asked Jacobson if he could move the landscaping strip along Main Ave. Jacobsen said no because that would require removing asphalt. Jacobson would like to add green space but with the site plan being so tight, it just isn't feasible.
