WHEREAS, the CITY OF BROOKINGS has heretofore determined the
necessity of making improvements to the Municipal Airport, and
WHEREAS, the CITY OF BROOKINGS has initiated Project No. AIP
3-46-0005-09 in conjunction with the Federal Aviation Administration
for the purpose of making improvements to the Municipal Airport of the
CITY OF BROOKINGS in order to comply with rules and regulations for
the operation of the Municipal Airport by the Federal Aviation
Administration, and
WHEREAS, the Governing Body of the CITY OF BROOKINGS has
determined that upon advice and counsel of the consulting engineer
that certain properties must be acquired by the City in order to
complete the improvements to the Municipal Airport, and specifically
properties belonging to ROBERT FISHBACK, TRUSTEE OF THE HORACE
FISHBACK TRUST OF 1967, now therefore,
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS:
I.
It is hereby declared necessary and in the best interest of the
City of Brookings to appropriate, condemn and purchase the title to
the following described parcel, to-wit:
Airport Fourth Addition and OL 1, OL 2 and the N1/2 of OL 3 all
in the NE1/4 of the NW1/4 of Section Thirty-five (35) Township
One Hundred Ten (110) North, Range Fifty (50) West of the Fifth
Principal Meridian, County of Brookings, State of South Dakota
(containing 18.82 acres more or less)
II.
BE IT FURTHER RESOLVED that it is necessary to condemn and
purchase the hereinbefore described parcel for the purpose of
expansion and improvement of the Municipal Airport for the CITY OF
BROOKINGS, South Dakota.
III.
BE IT FURTHER RESOLVED that the City Attorney for the CITY OF
BROOKINGS, South Dakota, be and he is hereby authorized to initiate
and prosecute such proceedings as are necessary to effect the
appropriation and condemnation of the hereinbefore described parcels.
