A RESOLUTION PLACING A MORATORIUM ON THE ISSUANCE OF NEW ON-SALE
MALT BEVERAGE RETAILER LICENSES AND DECLARING AN EMERGENCY.
WHEREAS, there has been a significant increase in the number of
applications for on-sale malt beverage retailer licenses since video
lottery was authorized by the South Dakota Legislature; and
WHEREAS, the City finds it is necessary to consider the social
and economic effects of video lottery within the City of Brookings;
and
WHEREAS, the City finds it necessary to consider the possible
adoption of a comprehensive policy and ordinances regulating the
issuance of new on-sale malt beverage retailer licenses in the City;
and
WHEREAS, the development of a comprehensive regulatory policy
within the city requires that city officials have an opportunity to
study the applicable issues and confer, and
WHEREAS, additional time is required to achieve the
aforementioned objectives;
NOW THEREFORE, BE IT RESOLVED BY THE CITY OF BROOKINGS, SOUTH
DAKOTA;
That a moratorium be placed on the approval of any new or
additional on-sale malt beverage retailer licenses issued within the
City until the City Commission has an opportunity to determine whether
a comprehensive policy and new ordinances regulating the issuance of
new on-sale and malt beverage retailer license are necessary. This
moratorium would not prevent the transfer or renewal of existing
licenses.
IT IS FURTHER RESOLVED that this Resolution is necessary for the
immediate preservation of the public peace, health, safety, or support
of the municipal government and its existing public institutions and
that this Resolution shall take effect upon the passage and
publication thereof.
