A RESOLUTION PERTAINING TO THE ISSUANCE OF NEW ON-SALE LICENSES
AND MALT BEVERAGE RETAILER LICENSES ISSUED OUTSIDE THE CITY OF
BROOKINGS AND WITHIN THE ONE-MILE JOINT JURISDICTIONAL AREA AND
DECLARING AN EMERGENCY.
WHEREAS, there has been a significant increase in the number of
applications for malt beverage retailer licenses since video lottery
was authorized by the South Dakota Legislature; and
WHEREAS, the City finds it is necessary to consider the social
and economic effects of video lottery both within the City of
Brookings and within its joint jurisdictional area; and
WHEREAS, the City finds it necessary to consider the possible
revision and adoption of ordinances regulating the issuance of new
on-sale licenses and malt beverage retailer licenses issued outside
the City of Brookings and within the one-mile joint jurisdictional
area; and
WHEREAS, the City also finds it necessary to consider
establishing a comprehensive policy effective both within the City and
within the one-mile joint jurisdictional area pertaining to the
issuance and regulation of new on-sale licenses and new malt beverage
retailer licenses; and
WHEREAS, additional time is required to achieve the
aforementioned objectives;
NOW THEREFORE, BE IT RESOLVED BY THE CITY OF BROOKINGS, SOUTH
DAKOTA:
That a moratorium be placed on the approval of any new or
additional on-sale licenses and malt beverage retailer license issued
outside the City and within the one-mile joint jurisdictional area
until new ordinances regulating the issuance of new on-sale and malt
beverage retailer licenses issued outside the City and within the
one-mile joint jurisdictional area have been evaluated or until such
time as the City Commission deems it to be in the best interests of
the Cit� :to rescind this resolution. This moratorium would not
prevent the transfer or renewal of existing licenses.
IT IS FURTHER RESOLVED that this Resolution is necessary for the
immediate preservation of the public peace, health, safety, or support
of the municipal government and its existing public institutions and
that this Resolution shall take effect upon the passage and
publication thereof.
