RESOLUTION NO. 16-91 PROVIDING FOR AN ELECTION FOR THE PURPOSE OF VOTING UPON AN INITIATED ORDINANCE WHEREAS, on the 15th day of March, 1991, there was filed with the City Finance Officer of the City of Brookings, petitions requesting that Ordinance No. 3-91 be adopted and referred to the electors for their approval or rejection and said petition appears in due form and signed by the required number of electors. NOW, THEREFORE, BE IT RESOLVED By the City Commission of the City of Brookings to submit the following Ordinance to a vote of the electors of said City on the 9th day of April between the polling places in the City of Brookings. ORDINANCE 3-91 AN ORDINANCE AMENDING Chapter 5 of the Revised Ordinances of the City of Brookings, and pertaining to Sunday sales or alcoholic beverages by on-sale licensees. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, THAT CHAPTER 5 OF THE REVISED ORDINANCES OF THE CITY OF BROOKINGS, SOUTH DAKOTA, BE AMENDED AS FOLLOWS, TO WIT: Section 5-7. SUNDAY OBSERVANCE. a. No person within the City shall sell, offer for sale, service, or allow to be consumed on the premises covered by a state license, any alcoholic beverages on Sunday, except for those on-sale licensees who possess a valid permit to operate a restaurant as provided for in Section 15-19 of the Revised Ordinances of the City of Brookings, South Dakota, who may sell, serve or allow to be consumed alcoholic beverages with the serving of food from one o'clock p.m. to twelve o'clock midnight. b. BALLOT Initiated Ordinance No. 3-91 STATEMENT: Ordinance No. 3-91 entitled "An Ordinance Amending Chapter 5 of the Revised Ordinances of the City of Brookings, and pertaining to Sunday sales of alcoholic beverages by on-sale licensees" was enacted by the Governing Body of the City of Brookings because an initiative petition signed by the voters of the City of Brookings has been filed in accordance with law. State law requires that said Ordinance now be submitted to the Voters of the City for approval or rejection. EXPLANATION: Ordinance No. 3-91, if approved, would permit the sale and consumption on Sunday, between the hours of 1: 00 o'clock p.m. to 12: 00 o'clock midnight, of alcoholic beverages on the premises of on-sale licensees who also have a valid permit from the City of Brookings to operate a restaurant. A vote yes would approve Ordinance No. 3-91. A vote no would defeat Ordinance No. 3-91 and retain the status quo. QUESTION: SHOULD ORDINANCE NO. 3-91 BE APPROVED? YES NO
