Vacation of Easements in Block 1, Morningside Addition
WHEREAS, The City of Brookings has been granted certain utility
easements in Block 1, Morningside Addition to the City of Brookings by
virtue of a Final Plat entitled Plat of Part of Blocks 1,2,3 and 4 and
Re-Plat of Lots 7 and 8 of Block l, a portion of the Morningside
Addition to the City of Broo.kings, South Dakota, and filed in Plat
Book 6, Page 128 and,
WHEREAS, John P. and Linda L. Feikena and Harry and Lillian
Greenbaum, owners of Lots 9 and 10, Block 1 Morningside Addition, have
petitioned the City of Brookings to vacate certain easements
previously granted so that expansion of the garage on Lot 10 may be
accomplished.
NOW, THEREFORE, BE IT RESOLVED By the Governing Body of the City
of Brookings that the easement shown on the above referenced plat in
Block l, Morningside Addition between Lots 9 and 10 be vacated, with
the cost of relocating existing utilities to a new easement being the
responsibility of the owner of Lot 10 or his assigns,
FURTHERMORE, That a copy of this resolution be filed with the
Brookings County Register of Deeds and that said Register of Deeds be
requested to mark upon the above referenced plat in Plat Book 6, Page
128 , the vacating of said easement and note reference to the proper
miscellaneous record.
