RESOLUTION NO. 10-91
AMENDING PERSONNEL POLICY
WHEREAS a comprehensive personnel policy governing the
organizational and operational affairs of the City of Brookings
employees has been adopted by the Brookings City Commission.
WHEREAS the Commission finds that amendments to certain policies
as set forth in said statement should be made.
NOW, THEREFORE, BE IT RESOLVED by the Brookings City Commission
that the personnel policy be amended as follows:
ARTICLE XII GRIEVANCE �8/�RBXTRI�TX�d� PROCEDURE
A grievance is defined herein as a dispute between the City of
Brookings, as the employer, and an employee of the City involving a
misapplication, misinterpretation or violation of the policies set
forth in this manual, that cannot or has not been satisfactorily
resolved as a result of discussions between the aggrieved employee and
his/her immediate supervisor and/or Department Head. Salary and wage
decisions made by the City Commission shall not be grievable under the
terms of this procedure, and the Grievance Committee constituted by
this procedure shall not have jurisdiction.
1. A formal grievance shall be in writing to the Department
Head, and shall contain the matter at issue, the facts upon
which it is based, and the controlling provisions of this
manual.
2 . All grievances shall be submitted in writing by the employee
to the Department Head within thirty (30) working days of
their occurrence or the complaint will be considered not to
exist.
3 . Upon receipt of the grievance, the employee involved and the
immediate supervisor and/or Department Head shall attempt to
resolve the grievance within five (5) working days.
4. Failing a resolution of the grievance within five (5) days
in Step 2, the matter shall be referred to the ¢X�}�/�'Xpt�ipi¢¢
���X¢��,� Commissioner in charge, who shall attempt to
resolve the grievance within five (5) working days.
5. Failing a resolution of the grievance within five (5) days
in Step 3, upon the request of the employee, the ¢X��
�'�pi�(pi¢�/���X¢��` Commissioner in charqe will set a meeting of
the Grievance Committee in an attempt to resolve the
grievance. In all cases, the decision of the Grievance
Committee shall be final. No employee shall be in any way
disciplined or held up to ridicule for seeking redress of
grievances in the above manner, and all discussions after
the formally submitted grievance, shall be treated with
confidentiality.
A Grievance Committee meeting for the above purposes, shall have the
authority to call any City employee for testimony on the matter before
them. Any employee, other than those directly involved in the

grievance, shall not be subject to disciplinary action as a result of
their testimony. The Grievance Committee may also instigate
investigations of any and all departments for the purpose of resolving
grievances. Parties to the grievance shall both be entitled to call
witneases and present evidence on their behalf.
Grievance Policy for Department Heads
If the Department Head has a grievance with the City of Brookings, the
Department Head shall meet with the City Commission as a whole, in
Executive Session, except for those positions that are under authority
of their appropriate appointive boards.
A qrievance filed aqainst a department head shall be submitted to the
Comntissioner in charqe who shall attempt to resolve the qrievance
within five (5) workinq days.
Failinq a resolution of the grievance �ithin five (5) days, the matter
shall be referred to the City Commission who shall make a final
resolution of the qrievance. The decision of the Commission shall be
final. ,
Grievance Committee
The aforementioned Grievance Committee shall consist of three (3)
members, who shall serve only when all other remedies to resolve the
grievance have failed. The committee membership shall consist of the
following:
One City Commissioner appointed by the City Commission as a
whole.

personnel director from the City Sospital.
One person from outside the City organization, but a resident of
the City of Brookings, who shall ��x`Jd�/�(�/¢pI�(X�`�����pi,! be
appointed by the City Commission.
The qrievance committee shall declare a chairperson from witbin the
committee. The chairperson sha11 ���j►�/�t�/��d�b�d���[�/������xi�i�*/��t
�dp�[�� arranqe for the securing of all information needed to make a

The Committee shall decide the Grievance and sball render a majority
report and set forth its findings in writing to the City Commission.
