WHEREAS, the City of Brookings has been granted certain utility
easements in Block 2, Boulevard Park Addition to the City of Brookings
by virtue of a Final Plat entitled Plat of a portion of Boulevard Park
Addition to the City of Brookings, South Dakota and filed in Plat Book
12, Page 86 and,
WHEREAS, Kosta and Katherine Theodosopoulos, owners of the
adjoining property have petitioned the City of Brookings to vacate a
certain easement previously granted, and
WHEREAS, Kosta and Katherine Theodosopoulos have on February 18,
1992, dedicated a replacement easement as recorded at the Brookings
County Register of Deeds office in Miscellaneous Book 125, Page 261,
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the City
of Brookings that the present easement along and north and south of
the north property line of Lot 18, Block 2, Boulevard Park Addition be
vacated including the five feet (5' > north of the said property line
and the five feet (5' ) south of said property line, and
FURTHERMORE, that a copy of this resolution be filed with the
Brookings County Register of Deeds and that said Register of Deeds be
requested to mark upon the above referenced plat in Plat Book 12, Page
86, the vacating of said portions of the easement and note reference
to the proper misaellaneous record.
Passed and approved this 28th day of April, 1992.
