A RESOLUTIOH ESTABLISHING THE POLICY OF THE CITY OF BROOKINGS
COHCERNIHG THE ISSUAHCE OF LICENSES FOR THE RETAIL SALE OF MALT
BEVERAGES AND WINE FOR THE YEAR ENDING JUHE 30, 1993.
WHEREAS, The City of Brookings issues alcoholic beverage licenses
for the retail sale of malt beverages and Mines, and
WHEREAS, the City Commission believes that video lottery should
not be linked to the issuance of licenses for the retail sale of malt
beverage or wine and that the State Lottery Commission and the
Legislature should study this issue, and
WHEREAS, the City Commission believes that applications for malt
beverage and �ine licenBes may be motivated by a desire to acquire
video lottery machines, rather than the desire to sell malt beverages
and wine,
NOW THEREFORE BE IT RESOLVED b the Cit Commission of the Cit

of Brookings as follows, to-Nit:
' 1. That no additional on-8ale licenses for the sale of malt
beverages or wine shall be issued for the year ending June 30,
1993.
2. Any license Nhich has been issued for the retail sale of
malt beverages or wine shall not be transferable, hoMever a neM
orrner of the premises of a licensed retailer of malt beverages
and wine may apply to the City Commission of the City of
Brookings for a license for an establishment to be located upon
the previously licensed premises.
3. Any person, firm or corporation receiving an annusl retail
license for the sale of malt beverages or wine shall agree that
the portion of the premises upon which said sale, use or
consumption occurs shall not be open except during the hours Nhen
such sale or consumption is legal.
IT IS FURTHER RESOLVED that the foregoing provisions do not
constitute an exclusive list of the requirements for the iesuance or
reneaal of license for the retail sale of malt beverages or rine and
that any application will be considered on its merit consistent pith
the past practices, policies and actions of the City Commission of the
City of Brookings.
