RESOLUTION DIRECTING PREPARATIOH OF ASSESSMENT ROLL,
DIVIDIHG ASSESSMENTS INTO INSTALLMEHTS, AHD PROVIDIHG FOR THE
COLLECTIOH THEREOF FOR ALLEY ASSESSMENT PROJECT 1992-10STA
(Between ist - 2nd Street from Medary - lith Avenue)
BE IT RESOLVED by the Board of Commissioners of the City of
Brookings, South Dakota, as folloNs:
1. More than twenty days have elapsed since the adoption and
publication of a Resolution of Hecessity for Alley Assessment Pro�ect
Ho. 1992-10STA. The referendum hae not been invoked, and no rritten
protests against the making of esid improvement have been filed Mith
the City Finance Officer.
2. A contract for Alley Aasessment Project Ho. 92-10STA (betrreen
lst - 2nd Street from Medary - lith Avenue) has been duly executed,
and the Board of Commissioners is authorized to levy special
assessments pursusnt to the provisions of chapter 9-43, SDCL 1967, as
amended.
3. The City Engineer has caused an estimate of the expense of
the rrork to be made and filed in his office ehoping the total cost of
said improvement as follows:
Contract price 56, 603. 77
Engineering, inspection,
fiscal, legal expense, publication 396. 23
Total Expense S7, 000. 00
4. The total cost of said improvement shall be paid as follorrs:
To be paid by City from Drainage Fund 83, 500. 00
Assessable costs 3. 500. 00
Total 57, 000. 00
5. There shall be made and filed in the office of the City
Finance Officer an asseasment roll for eaid improvement. The
assessmenta shall be on the basie of benefits upon each lot or tract
of land contiguous to the alley conetituting seid improvement.
6. The assessment shall be divided into five (5) equal annual
installments.
7. Unless paid to the City Finance Officer in advance of
maturity, the assessments shall be collected by the City Finance
Officer in accordance with the procedure for Plan One in Chapter 9-43,
SDCL 1967, as amended.
8. The interest rate to be borne by the unpaid installments of
the special assessment is ten percent ( 10%) .
