A RESOLUTIOH AUTHORIZIHG THE MAYOR TO SIGN A JOIHT POWERS

WHEREAS, the Second Century Environmental Pro�ection Act requires
a Solid Waste Evalustion Plan to be submitted by January 1, 1993;
THEREFORE, LET IT BE RESOLVED that the Mayor be authorized to
sign a �oint poaers agreement with the County of Brookings to prepare
a Solid Waete Evaluation plan for all or part of Brookings County.

WHEREAS, the Second Century Environmental Projection Act requires
a Solid Waste Evaluation Plan to be submitted by January 1, 1993;
THEREFORE, LET IT BE RESOLVED that the Mayor be authorized to
sign a joint poMers agreement aith the County of Brookings to prepare
a Solid Waste Evaluation plan for all or part of Hrookings County.

JOINT POWERS AGREEMENT
FOR REGIONAL SOLID WASTE EVALUATION
WITNESSETH:
Pursuant to the provisions of SDCL Chapter 1-24, the parties
hereto make and enter into this joint powers agreement for the
purpose of preparing a solid waste evaluation in satisfaction of
the requirements of SDCL 34A-6-70 .
I.
PARTICIPATING PIIBLIC AGENCIES
Appropriate action has been taken by ordinance, resolution,
or as otherwise provided for by the law of the governing bodies
of the following public agencies to enter into this agreement to
prepare a joint solid waste evaluation:
The City of Brookings and the County of Brookings enter into
this Joint Powers Agreement, however the County of Brookings
shall include only the following cities which have agreed to the _
terms and conditions of this Joint Powers Agreement:
Aurora Elkton Volga
Bruce Sinai
Bushnell White
Any cities located in the County of Brookings which are not '
set forth either above or on any addendum to this Agreement shall
not participate in this Agreement.
II.
DORATION
This agreement shall be in force and effect upon appropriate
action by ordinance, resolution or as may be otherwise ratified
by law by the governing bodies of all the parties to this agree-
ment and shall remain in effect until the solid waste evaluation
provided for under SDCL 34A-6-70 is completed and submitted to
Ilj the Board of Minerals and Environment, but in no event shall its
duration exceed two (2) years from the effective date.
III.
ORGANIZATION
The powers of the public agencies participating in this
agreement shall be exercised by a committee comprised of one
representative from each of the parties to this agreement. This
representative shall be appointed by the governing body of each
public agency. The committee shall be delegated the authority to
exercise such powers as are necessary to comply with the provi- .
sions of SDCL 34A-6-70. The committee shall elect a chairperson
and vice-chairperson who shall preside at all meetings. All
expenditures necessary to perform activities under this agreement
shall be approved by the committee. Actions by the committee
must be with the unanimous approval of all members of the
committee.

PIIRPOSE
The purpose of this agreement is to prepare a joint solid
waste evaluation for the combined jurisdictions of the parties in
satisfaction of the requirements of SDCL 34A-6-70.
V.
FINANCING
The activities of the committee formed pursuant to this
agreement and such expenses, staff, consultants , contractual ser-
vices and any other expenses reasonable and necessary to perform
the joint solid waste evaluation as provided for by SDCL 34A-6-70
and SDCL 34A-6-71 which is the purpose of this agreement, shall
be recovered from the parties based upon the pro rata share of
each public agency on the basis of its population from the 1990
United States census. The parties may by mutual agreement pro-
vide an alternative method of financing the activities of the
committee if special circumstances indicate another method to be
more equitable. Funds required to perform the activities of the
committee shall be billed by the committee and promptly remitted
by the parties. Funds shall be separately maintained, and
accounts maintained of receipts and expenditures consistent with
the Office of Legislative Audits for governmental fund accounting.

VI.
TERMINATION
Participation in this agreement may be terminated by any
party at any time upon appropriate action to' terminate partici�a-
tion by ordinance, resolution or as otherwise provided for by the
governing law of the participating municipalities and counties
and by tendering written notice to the committee ninety days
prior to the termination.
VII.
OTHER MATTERS
Provided they are consistent with this agreement, the commit-
tee may perf orm any such other activities as are reasonable and
necessary to further the purpose of this agreement with the una-
nimous consent of the committee.
This document reflects the entire agreement of the parties
and may not be amended or modified except in writing, signed by
� the presiding officer of each party to this agreement.

A resolution authorizing the County Chairperson to sign a
Joint Powers Agreement with the City of Brookings to prepare a
Solid Waste Evaluation Plan.
Whereas the Second Century Environmental Protection Act
requires a Solid Waste Evaluation Plan to be submitted by January
1, 1993 and;
Whereas BrookinQs County has signed the agreement
designating the City of Brookings as the designated landfill for
the region;
Therefore, let it be resolved that the County Chairperson be
authorized to sign a joint powers agreement with the City of
Brookings to prepare a Solid Waste Evaluation plan for all or part
of Brook�ngs County. C .
