HomeMy WebLinkAboutResolution 117-1992 � ` , � RESOLUTIOH MO. 117-92 ESTABLISHIHG ANNUAL SALARIES AAD BONDS OF THE ELECTED OFF'ICIALS AHD APPOINTED OFFICERS OF THE CITY OF BROOKINGS, SOUTH DAKOTA BE IT RESOLVED By the City Commissioners of the City of Brookings, South Dakota, that the annusl salaries of the elected officials and appointed officers of the City of Brookings, effective January 1, 1993 ehall be as follops: POSITIOH SALARY Attorney 530, 000 Commissionere 8, 700 Engineer 47, 423 F'inance Officer 43, 197 Fire Chief 34, 199 Deputy Health Officer 35, 855 Liquor Store Manager 30, 002 Mayor 14, 200 Park & Recreation Director 39, 407 Park 8� Recreation Director receives 52, 100 per annum for use of pereonal vehicle Police Chief 39, 171 Street Superintendent 33, 941 FURTHER BE IT RESOLVED That all elected and appointed officials, board members, and designated employees of the City of Brookings in the various Departments shall be covered by the blanket officisl bond, conditioned upon the faithful performance of the duties of their position, and to account, pay over, and deliver all money or property coming into their hands by virtue of their position according to 1aM, in the sum of 85, 000 for esch such official, board member, designated employee, Mayor and Commissioners, and that the bond of the City E'inance Officer is in such amount as provided by Section 9-14-6. 1 of SDCL and acts amendatory thereto; and FURTHER BE IT RESOLVED That the salary scale and longevity pay of all employees under the jurisdiction of the City Commission shall be approved by Resolution for the year 1993; and FURTHER BE IT RESOLVED That the pay period aill be the last day of esch month. Box 686 Brookings, S.D. 57006 Ph. i605) 692-2111 January 6 , 1993 Mayor Orrin Juel 1063 Circle Drive Brookings , South Dakota 57006 Dear Mayor Juel : It was recently brought to my attention by CHARLES KUECHENMEISTER , a resident of the City of Brookings , that he questioned the validity of the recent resolution increasing the salary of the Commissioners and Mayor because it had not been done in September . Following his inquiry, I checked our City Ordinance , Ordinance No. 5-83 Which is set forth in Sections 2-22 and 2-23 of the Revised Ordinances of the City of Brookings . Those ordinances were adopted in 1983 • They clearly establish that the salaries must be set by resolution adopted in September. In view of the conflict with the most recent resolu- tion which was adopted in December , I am of the opinion that the resolution , as it pertains to salaries of Commissioners and the Mayor , would be invalid in that it is in conflict with Section 2-22 and 2-23 of the City Code . I have prepared a proposed ordinance amending Sections 2-22 and 2-23 , a copy of which I am enclosing for your information . I am of the opinion that you should adopt the proposed amended ordinance and you can thereafter adopt the resolution which pro- vided for the salary increase. AN ORDINANCE OF THE CITY OF BROOKINGS , SOUTH DAKOTA, AMENDIVG SECTIOi1S 2-22 AND 2-23 OF ORDINANCE 715 OF THE REVISED ORDINANCES OF 3ROOKINGS , SOUTH DAKOTA, PERTAINING TO THE SALARIES OF MAYOR AND CITY COMMISSIONERS . BE IT ORDAINED BY THE GOVERNI`IG BODY OF THE CITY OF BROOKINGS THAT :,r.CTIONS 2-22 AND 2-23 OF THE REVISED ORDINANCES OF THE CITY OF 3ROOKINGS BE AND THE SAME ARE HEREBY AMENDED TO READ AS FOLLOWS , TO-WIT : Section 2-22 . Salary of Mayor . Tne annua� salary of the Mayor shall be set by resolutior. of the Cit� Commission in a regular meeting as defined in Section 2-17 of this code , said annual salary to be paid in equal monthly installments . Section 2-23 . Salary of Commissioners . The annual salary of each City Commissioner shall be set by the resolution of the City Commission in a regular meeting , as defined in Section 2-17 of tnis Code , said annual salary to be paid in equal monthly installments .
