WHEREAS, the City Commission of the City of Brookings is required
to review all applications submitted to the City for available on-sale
alcoholic beverage agreements and for on-sale malt beverage and Mine
licenses in accordance with SDCL 35-2 and
WHEREAS, the City desires to set forth its guidelines in order to
aid and assist prospective applicants for such licenses, now
theref ore,
BE IT RESOLVED that is shall be the policy of the City of
Brookings when considering applications for alcoholic beverage
licenses, that said licenses Nill not be issued to convenience grocery
stores, gas stations or other stores where groceries or gasoline are
sold unless it can be established that minors do not regularly
frequent such establishments.
BE IT FURTHER RESOLVED that the City will not issue such licenses
to establishments which are operated in a manner r►hich result in
minors regularly frequenting said establishments.
BE IT FURTHER RESOLVED that on-sale alcoholic beverage operating
agreements and on-sale malt beverage and wine licenses will not be
issued to convenience grocery stores, gas stations or other stores
where groceries or gasoline are sold and which regularly employ
minors.
BE IT FURTHER RESOLVED that other factors which rrill be
considered by the Commission in acting upon said license applications
shall be the hours that business is conducted and the capability of
adequately policing the proposed location.
BE IT FURTHER RESOLVED that the foregoing shall constitute
guidelines, but shall in no manner serve to exclude any other valid
ressons or factors which the Commission may consider in considering
applications for the foregoing licenses.
