RESOLUTIOH N0. 14-94 A RESOLUTIOH APPROVING FUNDIHG OF AN ECONOMIC DEVELOPMEHT POSITION OF THE BROOKIHGS AREA CHAMBER OF COMMERCE WHEREAS, the Brookings Area Chamber of Commerce is attempting to establish a ner► economic development position of employment and requires additional funding for said position, and WHEREAS, the proposed economic development position rrill promote the City of Brookings, and WHEREAS, the City would fund said economic development position with funds to be transferred by the Brookings Municipal Utilities, and WHEREAS, the governing boerd of the Brookings Municipal Utilitiee has advised the City Commission that it desires to transfer the sum of 550, 000. 00 each year for a period of two (2) years to the City to then be paid to the Brookings Area Chamber of Commerce to fund an economic development position of employment, nop therefore BE IT RESOLVED by the Governing Body of the City of Brookings that the proposed economic development position of the Brooking Area Chamber of Commerce be funded for two (2) years in the amount of 550, 000. 00 per year and that the sum of 5100, 000. 00 be transferred by the Brookings Municipal Utilities to the City and that said sum of 550, 000. 00 per year be paid to the Brookings Area Chamber of Commerce for the purpose of funding an economic development position of employment for a period of two (2) years. Passed and approved this 25th da of January, 1994. � Mayor `eROpk�N c: �� �'�O c`� y�pA�.9 �� , � 80 -��0., o� � Fina�l�'� Officer ` ( • �' RESOLUTION NO. 2 - 94 r ��� • RESOLUTION AMENDING RESOLUTION NO. 33-93 PROVIDING FOR FORMULAS FOR TR.ANSFER OF UTILITY SURPLUS FUNDS TO THE CITY GENERAL FUND AND SCHOOL DIS�RICT WHEREAS the Broakings Mu�icipal Utilities passed Resolution No. 33-93 providing for the formula used to calct�late the transfer of Utility st�rplus f�nds to the City General Fund and School District 5-1 beginning January 1, 1994; and WHEREAS it is the intent of the Brookings Municipal Utilities to change the above established formulas used to calculate the transfer of surplus funds by adding thereto the amount of $�00,000.00 for the year 1994 in accQrdance with the request of the City Commission as expressed in their ResoZt�tion No. 14-94 which resolution �s �ereby incorporated and made a part hereo€. NOW, THEREFORE, BE IT RESOL�IED by the Brookings M�nicipal Utilities Board that Reso�t�tion Na. 33-93 be amended to provide that, beginning Jant�ary 1, 1994, transfers be made to the City Ge�eral Fund and Brookings School District 5-1 from the Telephone and Electric Funds in amounts as established by the following for4nula: Electric Fund Total Gross Revenues X 4.90% to the Cit� General Fund To�.al Gross Revenues X 1.10% to Brookings School District 5-1 Telephone Fund *Total Gross Revenues X 28a to the City Ge�eral Fund Plus $200,Q�0.00 to the City General Fund/Community Bettermen� Fund Plus $100,000.00 to the City General Fund designated for the Brookings Area Chamber of Commerce and Convention Bureau. *Tota� Gross Revenues X 4. 35% to the Brookings School District 5-1 *Excluding revenues der�ved from deregulated and telemarketing activities. Anderson, Pres�.dent AGREEMENT FOR THE TRANSFER OF SURPLUS UTILITY FUNDS THIS AGREEMENT , made on this 14th day of February � 1994 , between the Brookings City Commission and the Brookings Municipal iltilities Board , a municipal corporation of the State of South Dakota , WITNESSETH: WHEREAS, the City Commission has approved Resolution No. 14-94 which provides that money under the control of the Brookings Municipal Utilities Board be used toward payment of salary expenses of the Economic Development Director for the Brookings Area Chamber of Commerce and Convention Bureau; and WHEREAS , SDCL 9-12-11 provides that the City Commission may expend funds for the promotion of the City through payments to the Chamber of Commerce ; and WHEREAS , SDCL 9-39-24 provides that the Utility Board may enter into agreements for the transfer of surplus funds under its control to the General Fund of the City Commission. NOW THEREFORE , BE IT RESOLVED in consideration of the mutual undertakings herein contained the parties hereto agree as follows : Section 1 . TERM. This a�reement shall become effective on the day , month and year first written and shall remain in effect for one year or until terminated by the City Commission or the Utility Board giving to the other not less than six month's written notice of its intention to terminate . Section 2 . The Utility Board shall , as described in Section 3 below, transfer funds to the City General Fund. The City Commission shall , in turn , transfer these funds to the Brookings Area Chamber of Commerce and Convention Bureau. The City Commission may elect to transfer the funds in increments of $50, 000 in 199u and $50, 000 in 1995 . Section 3 . UTILITY TRANSFERS . A transfer shall be made in the month of March in the � � _ : amount of $100, 000 designated for the Brookings Area Chamber of Commerce and Convention Bureau.
