PROFESSIOHAL SERVICES AGREEMEHT FOR AIP 3-46-0005-09
(Airport Clear Zone Easemente)
WITH BROOKINGS REAL ESTATE CENTER, IHC.
BE IT RESOLVED by the City of Brookings, South Dakota, that the
City Commission hereby approves up to 54, 800 in professional Bervices
to Brookings Real Estate Center, Inc. , for acquisition of Avigation
Easements for the Instrument Landing System at the Brookings Municipal
Airport.
BE IT FURTHER RESOLVED that the Mayor be authorized to aign said
agreement on behalf of the City of Brookings.
This approval is conditional on the concurrence of SDDOT and FAA.
Paesed and approved this 18th dey of Janusry, 1994.

The Brook�ngs City Commission, at their January 18, 1994
meeting, apprcved the enclosed proposal for professional services
to acquire easz�ents for the Instrument Landing System for the
Brookings Municipal Airport. A copy of the completed proposal is
enclosed for your files. Work may begin on this project immed-
iately. Pleasa keep accurate records of the time spent on this
work so that billing and auditing will be simplified.

The following is a proposal to offer the professional services of Century 21 Brookings Real Estate
Center, Inc. to solicit, negotiate and obtain avigation easements for the City of Brookings and to
act as The Right of Way Agent.
The following parcels of land and owner of record have been provided by the City of Brookings
and are inclusive of the property in need of the Avigation Easements for the Runway Protection
Zone:

The City of Brookings will provide the necessary documentation to Century 21 Brookings Real
Estate Center, Inc. to be able to obtain such easements. The material to be provided will include
the parcel numbers off of appropriate maps, legal descriptions, owners of record, title opinions,
letters including the offer to each owner, estimates of value for each easement, the actual
easement, acknowled�ement of owner, runway protection zone and transitional zone sketch's, an
adequate number of"Land Acquisition for Public Airports" booklets, sample agent record of calls
forms and any other documentation that is necessary for this project.
Century 21 Brookings Rea1 Estate Center, Inc. offers to use two South Dakota licensed real
estate brokers, one South Dakota licensed real estate salesperson and two support staffto
complete this project.
Completion of the project will be deemed to include all easements obtained or by obtaining the
maximum possible and with verification that unsigned easements were because of refusal of the
owner to accept the cit�s offer(s) deemed appropriate by the City Engineer.
Compensation by the City of Brookings to Century 21 Brookings Real Estate Center, Inc. will be
based on an hourly fee of$50.00 (Fifly dollars) per hour but not to exceed a total cost of
$4800.00 (Four Thousand Eight Hundred Dollars).
� Completion deadline is May 1, 1994. Century 21 Brookings Real Estate Center, Inc. will be
entitled to a Five Percent (5%)incentive bonus if all easements are obtained by April 15, 1994.
The incentive will increase to Ten percent (10%) if all easements are obtained by April 1, 1994.
This amount will be based on the actual billed hours but not to exceed the maximum described
above.
