VACATION OF AN EASEMENT IN BLOCK 9, MAYLAND'S FIRST ADDITION
WHEREAS, the City of Brookings has been granted certain utility easements in Block 9,
Mayland's First Addition to the City of Brookings by virtue of Fina1 Plats entitled Plat of Lot 3 of
Block 4, Block 8 and Block 9 including Lot 1 of Block 9 of Mayland's First Addition and ; Replat
of Lot 3 of Block 3, Block 8 and Block 9 of Mayland's First Addition and; Plat of Lot 2 of Block
9 of Mayland's First Addition to the City of Brookings, South Dakota and filed in Plat Book 15,
Page 50; Book 16, Page 3; and Book 17, Page 21.
WHEREAS, Lomar Development Company and TCF Blower Division, Inc., owners of
the adjoining property, have petitioned the City of Brookings to vacate a certain easement
previously granted.
NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of
Brookings that the present easement along and five feet (5')north and south of the property line
between Lot 1 and Lot 2, Block 9, Mayland's First Addition be vacated.
FURTHERMORE, that a copy of this resolution be filed with the Brookings County
Register of Deeds and that said Register of Deeds be requested to mark upon the above
referenced plats in Plat Book 15, Page 50; Book 16, Page 3; and Book 17, Page 21 the vacating
of said easements and note reference to the proper miscellaneous record.
Passed and approved this 21 st day of March, 1995.
