OCCUPATION AND USE OF AN EASEMENT
LOT 5, MEYER'S SUBDIVISION(30-110-49)
BE IT RESOLVED BY THE CITY OF BROOKINGS, SOUTH DAKOTA:
WHEREAS, the City of Brookings has been granted certain utility easements in Lot 5,
Meyer's Subdivision (30-110-49)by virtue of a utility easement agreement filed In Misc. Book
123, Page 293-295 and,
WHEREAS, the City of Brookings, owner of the adjoining property, plans to construct a
fire station on the adjoining property,
AND WHEREAS, this fire station will encroach onto and over a portion of this easement
and the Brookings Utilities has concurred in this encroachment as long as the existing utilities in
the easement are adequately protected,
NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of
Brookings that said encroachment be allowed.
Passed and approved this 30th day of May, 1995.
