HomeMy WebLinkAboutResolution 66-1995 RESOLUTION NO. 66-95 BE IT RESOLVED BY THE CITY OF BROOKINGS, SOUTH DAKOTA: WHEREAS, Michael J. McClemans and Katherine A. McClemans, owners of the hereinafter described real property, has submitted to the governing board a proposed plat of the following described real estate situated in the City of Brookings in the State of South Dakota to wit: Lots 1,2 and 3, Block 2 and Block 3 McClemans Addition in the City of Brookings, located in the SE1/4 of Section 35, T110N, RSOW of the Sth P.M., Brookings County, South Dakota, and the Board of City Commissioners of said City having examined the proposed plat and it appearing that all municipal taxes and special assessments, if any, upon said plat and survey have been executed according to law. NOW, THEREFORE, BE IT RESOLVED that said plat and survey by and are hereby in all things accepted and approved. This final plat on McCleman's property designates future park land to be used for a neighborhood park(Lot 1 of Block 2)that connects to a future neighborhood park in Pheasant Nest, ultimately providing an approximate 11 acre park. Lot 2 of Block 2 (20 ft. strip on North) plus Block 3 (125 ft. on east) will accommodate the recreational trail extension we have been pursuing for three years. I have a verbal agreement with Mike McClemans to acquire this property through an exchange, trading $16,900 worth of upcoming street assessments for the nearly 11 acres of land. This approximates the cost Mr. McClemans has invested per acre in the total parcel he purchased last fall, which I feel is a commendable and reasonable offer on his part. We do need to be aware, of course,that future street costs on Medary, south of 15th Street South, become the city's responsibility as adjoining landowner. However, curb and gutter may not extend beyond 15th Street South, and special drainage consideration also need to be incorporated into future street construction, so there are other advantages for city ownership of this strip. I plan on having a written agreement to accomplish this land transfer ready for your July 25th meeting. I anticipate no reason to need an executive session to discuss this, as its all pretty straightforward, unless you wish to do so, or there is strong disagreement with the proposal.
