RESOLUTION NO. 69-96
PERMITTING SERVING AND CONSUMPTION OF INTOXICATING BEVERAGES
IN THE CITY HALL COMPLEX
WHEREAS, with limited exceptions, the consumption of into�cating beverages in a
public place is prohibited by SDCL 35-1-5.3, and
WI�REAS, the City of Brookings Volunteer Fire Department conducts certain training
activities and social functions in a public place (City Hall), where intoxicating beverages are
available to members of the Volunteer Fire Department and their guests, and
WI�REAS, the City Commission of the City of Brookings is willing to permit this
activity, subject to restrictions hereinafter specified, now therefore,
BE IT RESOLVED by the City Commission of the City of Brookings that the Volunteer
Fire Department of the City of Brookings shall be permitted to serve intoxicating beverages in
appropriately designated rooms in the City Hall complex during social functions sponsored by the
Volunteer Fire Department and following training sessions and meetings of said Volunteer Fire
Department, subject to the following conditions.
1. That no social event or occasion where intoxicating beverages are served shall exceed
three (3) hours.
2. That said intoxicating beverages may not be sold.
3. That said intoxicating beverages may not be served to any person who is not
authorized by law to consume same and that all Standard Operating Procedures presently used by
the Volunteer Fire Department regarding drinking and designated drivers shall be adhered to at all
times.
4. That the Fire Chief of the City of Brookings shall provide to the City Finance Officer
written notice of the proposed occasions where alcoholic beverages shall be consumed in the City
Hall premises and shall provide to the City Commission an annual written report detailing the
functions and occasions wherein alcoholic beverages were consumed throughout the past year,
said report to be submitted on or before the 16th of January of the year following the reporting
period.
