Vacation of a Portion of a Drainage Easement in Lot 8 of Block 3, Brookdale Addition
WHEREAS, The City of Brookings has been granted a certain drainage easement in Lot 8 of
Block 3, Brookdale Addition to the City of Brookings by virtue of a Final Plat entitled Plat of Lots 8
and 9, Block 3 and Lot 36, Block 7, Brookdale Addition to the City of Brookings, South Dakota, and
filed in Plat Book 13, Page 50 and , �

WHEREAS, Kenneth P. Nelson, owner of Lot 8, exc. the N8' thereof and all of Lot 9; Block 3
Brookdale Addition, has petitioned the City of Brookings to vacate a portion of a drainage easement
along the south 10' of Lot 8 previously granted.
' NOW, THEREFORE, BE IT RESOLVED By the Governing Body of the City of Brookings
that the west one hundred seven(107) feet of the easement shown on the above referenced plat in Lot
8, Block 3, Brookdale Addition along the south ten(10) feet of the lot be vacated.
FURTHERMORE, That a copy of this resolution be filed with the Brookings County Register
of Deeds and that said Register of Deeds be requested to mark upon the above referenced plat in Plat
Book 13, Page 50, the vacating of said portion of the drainage easement and note reference to the
proper miscellaneous record.
Passed and approved this Sth day of August, 1997.
