Vacation of Easements in Lot 2 & 3 of Block 5, Gilkerson Addition
WHEREAS, The City of Brookings has been granted certain utility easements in Block 5,
Gilkerson Addition to the City of Brookings by virtue of a Fina1 Plat entitled Plat of Lots 2,3 and
4 of Block 5, Gilkerson Addition to the City of Brookings, South Dakota, and filed in Plat Book
18, Page 18 and ,
WHEREAS, Jerry Leutzow, President of MTR, Inc., owner of Lot 2, and the East 400'
of Lot 3, Block 5 Gilkerson Addition, has petitioned the City of Brookings to vacate easements
on the West 10' of Lot 2 and the East 10' of Lot 3 previously granted.
NOW, THEREFORE, BE IT RESOLVED By the Governing Body of the City of
Brookings that the easement shown on the above referenced plat in Block 5, Gilkerson Addition
between Lots 2 and 3 be vacated.
FURTHERMORE, That a copy of this resolution be filed with the Brookings County
Register of Deeds and that said Register of Deeds be requested to mark upon the above
referenced plat in Plat Book 18, Page 18, the vacating of said easement and note reference to the
proper miscellaneous record.
Passed and approved this 27th day of May, 1997.
