RESOLUTION NO. 20-97 AUTHORIZING THE MAYOR TO SIGN A JOINT POWERS AGREEMENT WITH THE CITY OF SIOUX FALLS GOVERIVING BODY RELATED TO SOLID WASTE ACTIVITIES. WHEREAS, the City of Brookings and the City of Sioux Falls cooperating together can cost share on the ownership and operation of specialty landfill equipm�nt and, WHEREAS, the City of Brookings and the City of Sioux Falls can jointly apply for a Solid Waste Grant for purchasing a tub grinder and a trommel screen and, WHEREAS, the City of Brookings and the City of Sioux Fa11s working together on public education can enhance Solid Waste Management in the southeast part of the State of South Dakota. LET IT BE RESOLVED that the Mayor of the City of Brookings be authorized to sign the Cooperative Agreement with the City of Sioux Falls. Passed and approved this 18th day of March, 1997. MCGRATH DATE: MARCH 18, 1997 RE: Information on Cooperation betMeen Local Governments and information on cooperation betveen Local Governments and the Private Sector Discussion: There has been a long history of Solid Waste Departments from both cities and counties porking together on various issues related to garbage collection and disposal. Traditionally, the cooperation has been informal and limited to the staff level. However, lately the cooperation has become more formal twritten agreements) and has involved the elected officials as pell as the employees. The cooperation betWeen local governments has also extended to the private sector both at a formal level and an informal level. The following are examples of both formal and informal cooperation involving solid waste issuea. Infor�al Exawoles of Local Govern�ent 1. Sharing of transportation to and from Morkshop/seminars 2. Exchange of information related to hoK to best handle special waste. 3. Exchange of Information on problems related to equipment or contractors. 4. Hotification of next closest landfill if a hauler is not paying landfill bills. 5. Informal agreements to aid other landfills in cases of natural disasters such as floods, tornadoes, etc. 6. Sharing of bids for equipment supplies common to all operations. 7. Making sure other operations are aware of any pending chargea in regulations or legislation at state level. For�al Exa�ples of Local Govern�ent Cooveration 1. Agreements Mith cities and counties to provide solid Maste disposal capacity for communities. (For•��1 R�giQn�li�ationf 2. Agreements with cities and counties to have the landfill do the solid waste evaluation plans as required by state law. 3. Agreemente with cities and counties to have the landfills to develop the Source Reduction and Recycling Plans as required by state law. 4. Cooperative agreement between Brookings and Sioux Falls to cost share on apecialized equipment. This agreement also covers public education betveen Brookings and Sioux Falls. E_x_a�ples of infor�al C000eration Efforts betveen Governw�ents and Frivate Sectors 1. The City of Brookings and Cook's Wastepaper Service share aome collection accounts such as the Hospital. The City provides the dumpster and collects the garbage four (4) days a peek. Cooks Wastepaper Service collects the garbage tWice a peek and provide the recycling service. 2. Share transportation costs to workshops and other meetings. 3. Share information on equipment, articles and assist each other in public education efforts. Buying Used Government Garbage trucks through the bidding proceas. , . -�� ' . Section III The cooperative undertaking will be financed by the parties and by grant funds. It is estimated that the equipment will cost $500,000 with $250,000 of that to be funded by state solid waste grant funding. Section IV The director of the Sioux Falls Health Department shall be responsible for administering the joint undertaking. All costs, including purchase, maintenance, and operation of the equipment will be divided between Sioux Falls (80 percent) and Brookings (20 percent). '� ��`�` , 1997, between the City of Sioux Falls and the City of Brookings pursuant to SDCL 1-24 for the purpose of providing for joint ownership and administration of solid waste management equipment. The parties agree as follows: Section I 1. They will jointly apply for partial grant funding for purchase of a tub grinder and trommel screen for use of their respective landfill operations. 2. They will cooperate in determining a method whereby a single entity or person will operate the equipment. The parties will create a legal relationship through contract with the operator describing the rights and responsibilities of the two cities. 3. They will cooperate in developing a public education program to encourage waste reduction, recycling, and nuisance reduction. 4. They will cooperate in other jointly beneficial solid waste management projects. Section II This agreement shall continue until terminated by either of the parties. Title to property purchased under this agreement sllall be in the City of Sioux Falls. Upon partial or complete termination, the property purchased will be disposed of by purchase by one party of the other party's interest or by applicable surplus property disposition law with proceeds to the parties in proportion to their investment in the equipment.
