RESOLUTION NO. 18-97
AUTHORIZATION TO PURCHASE ALTERNATE DAILY COVER MATERIAL FOR
THE SOLID WASTE DEPARTMENT
WI�REAS, the City of Brookings, Solid Waste Disposal Department has a need for
Alternate Daily Cover Material and
WHEREAS, the City of Brookings would purchase off the Brown County bid proposal.
BE IT RESOLVED by the City of Brookings, South Dakota that the Director of Solid
Waste Management be authorized to purchase ConCover SW at $63.50/unit or Proguard at
$65.80/unit from New Waste Concepts, Inc. of Erie, Michigan.

This I.etter is to inform you that the Brown County Landfill will be
accepting bid3 for alternative daily cover material for the year
1997.
Brown County is requiring a proposal guarant� which would include a
certified check, cashier`s check or bank ciraft in the amount of five
percent (5%) of the total amount of the bid or a bidder may furnish
a bid bond for ten percent (10%) of the bid_ (SEE PROPOSAL GUAR.ANTY
IN NOTIC�) The proposal guaranty`s shall be based on the estimated
amount of alternative daily cover material the Brown County Landfill
will use in 1997 based on a worki.ng face area 50 feet x 100 feet
four times per week at an application rate of 1/4 inch or less_
Bids will be openc�d at 8:45 a_m_ Tuesday, January 28, 1997_

Board of Commissionsrs at the Courthouse Annex, Aberdeen, South
Daka::a - 57401 until the hour of 8:45 A.2�I. Tuesdai►, ►Tanuary 28, I997

Proposal Guarantv: The proposal guar�nty req�ired and which must
accompany each bid is a certi�i�d �heck, a cashier's check or bank
draft certified or issued by a national or sta�e bank and payable at
sight to Brown Countv, South Dakota 57401, i_i the amount of five per
cent (5%) of the totai amount of the bid, or in lieu thereof, a
bidder may furnish a icid bond for ten per cent (l00) of the bid,

Brown County is e:�empt from all I'ederal Excise Tax and State Sales
Tax.

ConCoverO has been extensively tested for approval as an ADCM in
accordance with Subtide D regulations. The number of tests required and
successfully completed is substantial. We have included a checklist of these
for you and your regulators to review. We also are providing you with the
supporting documents. We encourage you to compare other products to this
testing standard.
You should be aware, that even products approved by the state could be subject
to citizen lawsuits according to the new Subtitle D regulations. This is why we
at NWC have done extensive testing and pioneered the use of ConCover as a
high qualiry, durable, and safe product.
NWC has available a wide range of covers other than ConCover, although the
performance characteristics of these products aze different. If your regulatory
environment is such that a lesser product than ConCover can be used,we
would be happy to discuss your specific needs with you. These other NWC
products, which also meet minimum standards, can be supplied economically
by NWC to meet your application. To illustrate,we have prepared and
separately submitted a bid for a lower quality,lower cost product,Proguard
We believe that ConCover is the best product to meet the needs of the citizens of
Brown County. However, if budgetary restrictions take precedence over safety
and quality, we believe that Proguazd is an option that will satisfy your
parameters.
NWC wishes to provide you with the highest quality daily cover material
meeting all the Subtide D standards. NWC has invested time, and considerable
financial resources to provide our customers with a product that is both safe to
use and effective. Please review the enciosed literature and call me to discuss
your specific application concerns.
Please understand that if other materials are used in the CAPS machine,NWC
cannot continue to support the equipment.
