VACATION OF AN EASEMENT IN LOT 4 BLOCK 7,MORIARTY'S SECOND ADDITION
WHEREAS, the City of Brookings has been granted certain utility easements in Lot 4
Block 7, Moriarty's Second Addition to the City of Brookings by virtue of a Final Plat entitled
Plat of Lot 4 of Block 7, Moriarty's Second Addition to the City of Brookings, South Dakota and
filed in Plat Book 19, Page 120.
WHEREAS, Paul Moriarty, owner of the adjoining property has petitioned the City of
Brookings to vacate a certain easement previously granted.
NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of
Brookings that the present easement along and ten feet(10) south of the north property line of
Lot 4, Block 7, Moriarty's Second Addition be vacated. This does not include the ten(10) foot
easement around the cul de sac.
FURTHERMORE,that a copy of this resolution be filed with the Brookings County
Register of Deeds and that said Register of Deeds be requested to mark upon the above
referenced plat in Plat Book 19, Page 120 the vacating of said easement and note reference to the
proper miscellaneous record.
