RESOLUTION NO. 74-98 WHEREAS, Miller Sellers and Heroux Architects Inc. have been retained by the City of Brookings for the development of facilities for the proposed Brookings Agri-Plex and exhibition center and research center and WHEREAS. proposals for additional services are needed as per the original contract and WHEREAS, additional services request No. 15 is requesting additional services for the tenant improvements in the Lab/Research building which are designed and constructed by Mills Construction. Services shall include certification of payments and change orders to the owner based on the Architects observations at the site of the work of the contractor. Total Cost...............................one percent(1%) of the total construction costs for the tenant improvements. NOW, THEREFORE, BE IT RESOLVED that said addendum to the contract is hereby approved and the Mayor is authorized to execute same with the architects accordingly. Services shall include certification of payments and change orders to the owner based on the Architects observations at the site of the work of the contractor. The issuance of a Certificate for Payment shall further constitute a representation that the Contractor is entitled to payment in the amount certified. However, the issuance of a Certificate for Payment shall not be a representation that the Architect has (1) made exhaustive or continuous on-site inspections to check the quality or quantity of the Work, (2) reviewed construction means, methods, techniques, sequences or procedures, (3) reviewed copies of requisitions received from Subcontractors and material suppliers and other data requested by the Owner to substantiate the Contractor's right to payment or(4) ascertained how or for what purpose the Contractor has used money previously paid on account of the Contract Sum. The Architect shall visit the site at intervals appropriate to the stage of construction, become generally familiar with the progress and quality of the Work completed. However, the Architect shall not be required to make exhaustive or continuous on-site inspections to check the quality or quantity of the Work. On the basis of on-site observations as an azchitect, the Architect shall keep the Owner informed on the progress and quality of the Work, and shall endeavor to guard the Owner against defects and deficiencies in the Work.
