RESOLUTION NO. 50-99 WHEREAS the Brookings City Commission desires to do what is best for the Community of Brookings, and WHEREAS on August 25`�, 1998 the Brookings City Commission passed Resolution No. 94-98 expressing its concerns regarding how the impact of the proposed Dakota Minnesota& Eastern Railroad changes could effect the future of Brookings, and WHEREAS on November 3, 1998 the Brookings City Commission unanimously approved a motion to support the Dakota Minnesota& Eastern Railroad proposal if they would by-pass the City at their expense, NOW TI-�REFORE, BE IT RESOLVED that the Brookings City Commission still feels the need for Dakota Minnesota& Eastern Ra.ilroad to construct a by-pass around the City of Brookings, and FURTHER BE IT RESOLVED that the City of Brookings will take a proactive role with Dakota Minnesota&Eastern Railroad and Brookings County in promoting fair and adequate mitigation for people impacted along the proposed by-pass route. Steve Bublitz,representing the South Dakota Department oFLegislative Audit,presented a "schedule of current audit findings and questioned costs". Mr.Bublitz�Iso explained three recommenda[ions regarding his findings. City Attorney Glover was advised to review and respond in writing to the City Commission and Department of Legislative Audit. No official action was taken at this time. Motion was made by Klavetter,seconded by Artz that if the D M&E is willing to by-pass the city at their expense,the cit�will support the project as proposed. All members voted YES;motion carried. Motion was made by Murra,seconded by Plumart approving Resolution No. 124-98�ppointing Darrell Hartmann as the Brookings Fire Chief. All members voted YES;motion carried. RESOLUTION NO. 124-98 APPOINTMENT AND ESTABLISHMENT Or ANNUAL SALARY POR FIRE CI-IIEP FOR THE CITY OF BROOKINGS,SD. ' BE IT RESOLVED BY the governing body of the City of Broohings,State of South Dakota, that Darrell Hartmann is hereby appointed to the office of Fire Chief/Fire Marsliall effective NovemUer 9, 1998 for a tenn tenninating on the 31"day of December, 1998 subject to the right of removal as provided by State Statute.
