RESOLUTION NO. 26-00
WI�REAS, at times there is a need for contracted legal services outside of the scope of
the retainer agreement with the City Attorney, and
WHEREAS, the City Council approved a specific amount to be spent on the Bozied case,
and
WI�REAS, the City Council approved the use of a firm other than the City Attorney in
the Mills dispute, and
WI�REAS, there is under $500 of outstanding legal services provided by Alan Glover
that were outside the scope of that retainer agreement,
WHEREAS, other contracted services may be necessary;
NOW THEREFORE BE IT RESOLVED that $18,500 be transferred from the
contingency to the legal services budget thereby amending the 2000 budget, and
IT IS FURTHER RESOLVED that the"cap" established by motion on March 27, 2000
for legal services for the Bozied case be extended an additional $500.00.

RE: Transfer of Contingency funds 2:(�
DATE: April 19, 2000
A resolution is enclosed which will transfer conting�ncy money to the
legal services budget. This is for several reasons.
1. To allow for payment of uncovered legal costs for the Bozied case.
This amount is $6000. As shown on the attached report, we have
spent $5,590 of city funds. This is $234 over the Council's motion
on March 27. We tracked costs very closely since that motion. All
briefs are filed and we should have no more costs unless there
needs to be oral arguments. The resolution increased the cap by
$500 to keep close to your motion on March 27. However, I cannot
imagine the City Council forbidding legal counsel to represent the
City before the Supreme Court. My preference would be to amend
the resolution and authorize further expenditures to allow oral
arguments by lifting the cnp.
2. To allow for payment to Michael Hauck for representntion in the
Mills dispute. This is estimated at $5000.
3. To allow for payment to AI Glover for work invoiced on the Mills
dispute of $200 and the Miller Sellers Heroux dispute of $255,
increased to $1000 in case any actions by Glover are needed to
bring Hauck up-to-date (this is doubtful).
4. To allow for other contracted services of $6000, if necessary.
