STREET VACATION
WHEREAS, a petition to vacate has been filed with the City Clerk of the City of
Brookings, and
WI-�REAS, the petition was filed in proper form and signed by one hundred
percent(100%)of the adjacent property owners.
NOW, THEREFORE, BE IT RESOLVED,by the City Council of the City of
Brookings:
That portion of 10�` Street between 32"d Avenue and 34�'Avenue is hereby
vacated.
Passed and approved this 27�' day of March, 2000.

NOTICE is hereby given that Jeppesen, Inc. in Brookings has submitted a petition to
vacate the following:
That portion of 10`h Street between 32"d Avenue and 34`h Avenue
NOTICE is further given that said request will be acted on by the City Council at
5:30 p.m. on Monday, March 27, 2000 in the Council Chambers in the lower level of City Hall,
Brookings, South Dakota.
Any person interested may appear and be heard in this matter.

AGREEMENT RE VACATION OF STREET

THIS AGREEMENT made and entered into this .2 S- day of July, 1997, by and
between the CITY OF BROOKINGS, a Municipal Corporation, the BROOKINGS
ECONOMIC DEVELOPMENT CORPORATION, the AREA DEVELOPMENT
CORPORATION, INC., and GHP SYSTEMS, INC., WITNESSETH:
WHEREAS, the CITY OF BROOKINGS is selling Lot Two (2) of Block Seven (7),
Wiese Addition to the BROOKINGS ECONOMIC DEVELOPMENT CORPORATION, .
which in turn is selling said property to the AREA DEVELOPMENT CORPORATION, INC.,
which in turn is selling said property to GHP SYSTEMS, INC., pursuant to a Contract for
De�d, and
WHERE�S, Tenth Street, as it is presently platted, bounds said property on its southern
border, and
WHEREAS, it is contemplated that Tenth Street will be vacated under the new
development plans for Wiese Addition, and
WHEREAS, neither GHP SYSTEMS, INC., BROOKINGS ECONOMIC
DEVELOPMENT CORPORATION or AREA DEVELOPMENT CORPORATION, INC.,
have any objection to the vacation of Tenth Street, nor do they make claim to any of the
property which would ordinarily revert to them following vacation, now therefore,
FOR AND IN CONSIDERATION OF THE MUTUAL COVENANTS, PROMISES
AND CONDITIONS CONTAINED AND S�,T FORTH HEREIN, THE PARTIES DO
HEREBY CONTRACT AND AGREE AS FOLLOWS, TO-WIT:
The CITY and the Parties agree that part of the consideration for this document was the
sale and transfer of Lot Two (2) of Block Seven (7), Wiese Addition, to BROOKINGS
ECONOMIC DEVELOPMENT CORPOR.ATION, AREA DEVELOPMENT
CORPORATION, INC., and GHP SYSTEMS, INC.
GHP SYSTEMS, INC., BROOKINGS ECONOMIC DEVELOPMENT
CORPORATION and AREA DEVELOPMENT CORPORATION, INC., understand and agree
that Tenth Street may be vacated by the CITY OF BROOKINGS, and that neither party will file
any objections or in any other manner object to the vacation of Tenth Street and will, in fact,
sign any Petition to Vacate that may be circulated.
IT IS FIIRTI�R LJNDERSTOOD AND AGREED by and between GHP SYSTEMS,
INC.,BROOKINGS ECONOMIC DEVELOPMENT CORPORATION and AREA
DEVELOPMENT CORPORATION, INC., that in the event Tenth Street is vacated,that
neither GHP SYSTEMS, INC., BROOKINGS ECONOMIC DEVELOPMENT
