RESOLUTION APPROVING THE SDSU PERFORNIING ARTS FACILITY
PROJECT:
WHEREAS, SDSU has heretofore made plans for the construction and establishment of
a new Performing Arts Center, to include a 1000 seat music hall and 200 seat studio theatre,
said facility to be located to the northeast of the HPER Center a.nd north of McCrory Gardens
in the City of Brookings, and
WHEREAS, the City of Brookings intends to enter into a Memorandum of
Understanding with SDSU and the State of South Dakota for the use of said Performing Arts
Center, and
WHEREAS, the City of Brookings has heretofore, by Resolution Number 115-96 and
13-97, expressed its intentions to dedicate revenues from sales tax as provided in Ordinance
Number 95-96, and
WI�REAS, the 73`d Session of the Legislature of the State of South Dakota, by
Chapter 107, signed March 13, 1998, has authorized the Board of Regents to contract for the
construction of, equipping and furnishing of a Performing Arts Center at South Dakota State
University at an estimated cost of$10,400,000.00, and
WHEREAS, SDSU has presented a proposed Memorandum of Understanding to the
City of Brookings setting forth the terms and conditions of the City's participation in the
Performing Arts Center project and its future use thereof, now therefore,
BE IT RESOLVED that the City of Brookings shall participate in the Perfornung Arts
Facility Project with SDSU; shall enter into the proposed Memorandum of Understanding with
SDSU pertaining to same, and shall contribute $6,000,000.00 from revenues derived from the
second penny sales tax towards the development and construction of said project.
BE IT FURTHER RESOLVED that the City shall be authorized, if it deems
appropriate, to issue bonds in the amount of approximately $6,000,000.00 to be refunded and
paid by the second penny sales tax.
