RESOLUTION NO. 63-01
VACATION OF EASEMENT IN LOTS 22 & 23, BLOCK 6, BROOKDALE ADDITION
BE IT RESOLVED BY THE CITY OF BROOKINGS, SOUTH DAKOTA
WHEREAS, The City of Brookings has been granted a certain utility easement along
the north 5'of Lot 22 and the south 5'of Lot 23, Block 6, Brookdale Addition, granted to the City
of Brookings for the construction and maintenance of utilities. The easements were granted in a
plat, which was filed in the office of the Brookings County Register of Deeds on November 25,
1969, and recorded in Plat Book 8, Page 155, and
WHEREAS, The City of Brookings does not maintain any utilities in this easement and
there is no need for the City to retain an easement for the construction and maintenance of any
utility.
NOW,THEREFORE,BE IT RESOLVED by the Governing Body of the City of
Brookings that the easement on the north 5' of Lot 22 and the south 5' of Lot 23, Block 6,
Brookdale Addition as recorded in Book 8 of Plats, Page 155 be vacated.
FURTHERMORE,that a copy of this resolution be filed with the Brookings County
Register of Deeds and that said Register of Deeds be requested to file this to the proper
miscellaneous record and to note this action upon the original plat.
Passed and approved this 17�' day of December 2001.
