A RESOLUTION ASSIGNING A REFERENCE NUMBER FOR CURFEW
VIOLATIONS IN THE CITY OF BROOKINGS, SOUTH DAKOTA
BE IT RESOLVED by the City Council of the City of Brookings, South Dakota that Ordinance
No. 13-97 which is an Ordinance providing for Minors' curfew shall hereafter be cited as
Ordinance 25-50.

ORDINANCE NO. 13-97
AN ORDINANCE PROVIDING FOR MINORS' CURFEW
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS:
Sec. 1 Curfew Hours.
No minor under the age of si�rteen (16) years shall be or remain in or upon public streets,
alleys, parks, playgrounds, public places, public buildings, public places of amusement and
entertainment, vacant lots or other unsupervised public places within the City between the hours
of 11:00 o'clock P.M. and 5:00 o'clock A.M. of the following day, Sundays through Thursdays;
and 12:00 o'clock midnight to 5:00 o'clock A.M. the following day on Fridays and Saturdays.
Sec. 2. Egceptions to Curfew.
The provisions of this article imposing a curfew on minors shall not apply to a minor
accompanied by this parent, guardian or other adult person having the care and custody of the
minor or when the minor is upon an emergency errand or legitimate business directed or
authorized by his parent, guardian or such other adult person having the care and custody of the
minor.
Sec. 3. Responsibility of Parents.
It shall be unlawful for the parents, guardian or other adult having care and custody of a
minor under the age of sixteen (16) years to knowingly permit such minor to be or remain in or
upon the public streets, alleys, parks, playgrounds, public grounds, public places, public buildings,
public places of amusement and entertainment, vacant lots or other unsupervised public places
within the City between the hours of 11:00 o'clock P.M. and 5:00 o'clock A.M. of the following
day, Sundays through Thursdays; and 12:00 o'clock midnight to 5:00 o'clock A.M. the following
day on Fridays and Saturdays, except when the minor is accompanied by his parent, guardian or
other adult person having the care and custody of the minor or when the minor is upon an
emergency enand or legitimate business directed or authorized by his parents, guardians or other
adult person having the care and custody of the minor.
Sec. 4.
It shall be the right of any authorized officer or person to anest and detain any minor
violating the curfew and to keep the minor detained until the parent, guardian or custodian is
notified when the minor may be released upon the giving of a promise by the minor and his parent,
