VACATION OF EASEMENT IN LOT 2, SOUTHBROOK ADDITION

BE IT RESOLVED BY THE CITY OF BROOKINGS, SOUTH DAKOTA ,� �`._�

WHEREAS, T'he City of Brookings has been granted a certain utility easement in Lot 2,
Southbrook Addition to the City of Brookings by virtue of a Final Plat entitled Plat of�
Southbrook Addition to the City of Brookings, South Dakota,and filed in Plat Book 13, Page 7,
and
WHEREAS, The owner of Lot 2, Southbrook Addition has petitioned the City of
Brookings to vacate certain easements previously granted so that expansion of the building on
Lot 2 may be accomplished. �
NOW,THEREFORE,BE IT RESOLVED By the Governing Body of the City of
Brookings that the easement shown on the above referenced plat on the north ten feet of Lot 2,
Southbrook Addition be vacated.
FURTHERMORE,That a copy'of this resolution be filed with the Brookings County
Register of Deeds and that said Register of Deeds be requested to mark upon the above
referenced plat in Plat Book 13, Page 7, the vacating of said easement and note reference to the
proper miscellaneous record.
Passed and approved this 25`�day of Mazch 2002.

REQUEST FOR
VACATION OF EASEMENT
The City of Brookings has been granted Utility easements for the North Ten Feet
(N 10') of Lot 2, Southbrook Addition, Section 36, T110N RSOW. This plat is dated May
16th, 1978 and is recorded at the Brookings County Register of Deeds office in Plat Book
13, Page 7.
The Brookings Utilities, with agreeance from the following Utilities (Brookings
Telephone, Northwestern, MediaCom), proposes to vacate the following easement, more
distinctively described as the North Ten Feet (N 10') of Lot 2, Southbrook Addition,
Section 36, T1 lON RSOW.
