ORDZNANCE N0. 1- 75
. AN ORDINANCE ESTABLISHING A VOLUNTEER FIRE DEPARTMENT FOR THE
CITY OF BROOKINGS AND REPEALING SECTIONS 14-17 THROUGH 14-34 AND -
SECTION 14-64 OF THE REVISED ORDZNANCES OF THE CITY OF BROOKINGS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS,
TO-WIT :
I . Section 1. Fire Department, Establishment.
There is hereby continued, as heretofore established in
the City, a Volunteer Fire Department , consisting of a full
time Chief, two Assistant Chiefs , and no more than 50 firemen.
Section 2. Fire Chief� Duties
The full time Chief shall be the executive head of the ,
Fire Department and shall serve as the Fire Marshal for the
T City. He shall be appointed by the Mayor subject to the appro-
val of the City Commission. The Fire Chief shall also be t�e
head of the Bureau of Fire Prevention of the City and sha11 `
have full authority to execute all laws , ordinances and rules
relating to fire prevention, fire fighting and the Fire Depart-
ment of the City. He shall be responsible for the training and
discipline of inembers of the department and for the organization
thereof as an effective fire fighting unit ; he sha11 keep
records of all fires and fire calls , determine the cause of al].
fires and report the same monthly in writing to the Police �
Fire Commissioner; he shall be responsible for compliance by
the Fire Department and members thereof with all the laws , ordi-
nances and rules established by the City Commission and �or
directions received from the Police F� Fire Commissioner 'relat�ing
to the Fire Department. The Fire Chief shall be selected based
on his training , experience, executive and administrative
qualifications and overall merit and fitness . The choice of a
Fire Chief shall' not be limited to inhabitants of. the City ox
, the State but he shall be a citizen of the United States . If'
the qualificatio�s of the candidates for the posit¢s�fl of Fire
Chief are equal, the Mayor shall give a preference to applicants
who have served dn the City of Brookings Fire Department.
Section 3. Power of Chief to Arrest.
The Chief of the Volunt�er Fire Department , or in his
absence the on.e . i.n command at a fire shall have authority and

incendiary act or intent, and to take them before any magistrate
, or justice of the peace for criminal prosecution.

Chief. FThe�Mayor may �appoint assistant fire marshals to assist
and carry ou.t �.h� funGtions or responsibilities of said position
under the �i-rect`io� �of ;the Fire Marshal . The Fire Marshal shall
be chargec� witfi t'h�=' enforcement of all ordinances aimed at fire
prevention and sh�.l�l haye full authority to inspect all premises
and cause the r�mo'v�.l o� abatement of all hazards .

Section 6 . Eguipment and Reports .
The Fire Chief shall have control over all of the fire
fighting apparatus and shall be r�s�onsible for its care and
condition. He shall make a repor� sem�iannually to the Police
� Fire Commissioner as to the condition of the equipment on
or before February 1 and Au�ust 1 and"as to_ the needs of the
Fire Department. He may �ubmit additimn�l reports and recom-
mendations to the Police � Fire Commissioner as he deems

, Section 7. Equipment.

be provided and directed �by the 'City Commis�,�i�n and shall at all
times be ready for immediat� us�e. - -. �
Section 8. Discipline. �
The Fire Chief sha11 have the authority�. to �uspend any
member for refusal to obey orders br for •neglec�� in his duties
or for cause and said suspensions shall be made with the appro-
val of the Fire Department officers . �
Section 9 . Record of Fires .
The Chief shall keep in convenient form a complete record
of all fires . Such record shall include the time of the alarm,
location of fire, cause of fire (if known) , type of building ,
name of owner and tenant , purpose for which occupied, value of
building and contents , members of �he department responding to
the alarm, arid such other information as he may deem advisable
or as may be required from time to time by the City Commission
or State Insurance Department.
Section 10. Drill.
It shall be the duty of the Chief, when the weather permits ,
to hold a monthly practice drill of at least one hour' s duration
for the Fire Department and to give the firemen instruction in �
approved methods of fire fighting and fire prevention. ���
Section 11. Assistant Chief. I��
In the absence or disability of the Chief, the Assistant �
Chiefs shall perform all the functions and exercise all of the '
authority of Chief.
Section 12. Qualifications of Personriel . '�
The Assistant Chiefs and firemen shall be not less than �
eighteen (18) nor more than sixty-five (65) years of age and � 'i
able bodied. They shall become members of the Fire Department ,
only after one (1) year probationary period. The Fire Depart- I,
ment may require that each candidate, before he may beCome a '
probationary fireman, must satisfy certain minimum requirements
of height, weight, education and any other qualifications wh�ch
may be specified by the Fire Department; and th�t he must pass
a satisf actory mental and physical examination.

Section 13. Absence. -'
Firemen absent from 51� of drills or calls , shall forfeit �
membership in the Department. .

Section 14. Constitution and By-Laws .
The City Brookings Volunteer Firemen' s Association may
adopt such constitution and by-laws and rules for its regula-
tion and government , subordinate to the provisions of this
Code and ordinances of the City as it may deem best calculated
to accomplish the object of its organization.
Section 15 . Violations .
It shall be unlawful for any person to give or make , or
cause to be given or made , an alarm or fire without probable
cause, or to neglect or refuse to obey any reasonable order of
the Chief at a fire , or to interfere with the Fire Department
in the discharge of its duties .
II . That Sections 14- 17 through 14- 34 are hereby repealed.
III . That Section 14-64 of the Revised Ordinances of Brookings ,South
Dakota be and the same is hereby repealed.
IV. That any and all ordinances in conflict herewith are hereby !
repealed. I
