AN ORDINANCE MAKING IT UNLAWFUL TO FAIL TO STOP, . .
FLEE, OR ATTEMPT TO ELUDE A POL,ICE VEHICLE UPON VISUAL � '
OR AUDIBLE �IGNAL.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY;, ,
OF BRO:OKINGS, S�UTH DAKOTA: �
Section l. �Any dri�e'r of a motor vehiEle .wi�i�in the � � •
City of Brookings who willfully fails or � '
refuses,to �ring;his` ve�iiele to a;sto�, t�r who otherwise ` � �,�; ' '
flees or attempts to elude a pursuing police vehicle,
when given a visuai or audible signal to bring the v�ehicle : '
to a stop, shall be guilty of a misdemeanor.
Section 2. The signal given by the police offiec�r � �
may be by hand, voice, emergency light .
or siren. _ �
Section 3. The officer giving such signal shall be in
uniform, prominently displaying his badge - , .
of office, and his vehicle shall be appropriately marked
showing it to be an official police vehicle. �

Section 4. Any person convicted of fleeing or attemptin�� . . � �
to elude a police officer shall be puna�shed by °"
imprisonment for not more than six (6) months or by a
fine of not more than $500.00, or by both such fine and ` -
imprisonment.
Section 5. That any and all Ordinances or parts thereof
in conflict herewith are hereby repealed.
