AN ORDINANCE AMENDING SECTTON 808 OF THE BROOKINGS ZONIN�
ORDINANCE OF 1966 AS AMENDED �ERTAINING TO PROTEST AGAINS3' CHA�IGE.
BE IT ORDAINED BY THE �OVERNTNG BODY OF THE CITY OF $RE}OKINGS ,
SOUTH DAKOTA:
I . That Section 808 of the Brookings Ordinance of 1966 as
amended, be and the same is hereby amended to read as
follows, to��ri,t :
Section 808. Protest Against ��g�� The City� Pla�ning
Commission shall file its recammendations approving , dis-
approving or modifying the proposed amendment , supplement
or change with the City Commissioners within thirty (30)
days thereafter.
.1 If a written protest against any pro�osed amendment,
supplement or change shall h.ave been presented to the
City* Commissioners , signed by the ot�ners of at: �east
forty (40) per cent o£ the aggregate area (excluding
streets and alleysl of the lots included in the pro-
posed district and lots or parts of lo�s within one
hundred �ifty (15Q) �eet of any pro�osed district ,
such proposed amendment , supplement or change shall
not become ef�ective.
. 2 t�Fienevex a petition to rezone a parcel or parcels has
fieen denied by� the Ci.tY Commission, a petition or
request to xezone any part o� that parcel alone or
in combination with an otfier parcels shall not be
resufimitted �or one (1� year thereafter unless it be
signed by at least £ifty (50) per cent of the property
owners who previously objected to the change ; this
�xoyision, however, shall not prevent the City Com-
mission fxom acting on its own initiative in any case
or at any� time as provided in this section.
F�', Tfiat any and all ordinances or parts thereo£ in conflict
herewith are hereby re�ealed,
