ORDINANCE NO. 2- 74
AN ORDINANCE AMENDING SECTION 10-42 OF THE REVISED
ORDINANCES OF BROOKINGS, SOUTH DAKOTA, PERTAINING TO NOTICE
OF APPLICATION FOR BUILDING PERMITS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
BROOKINGS, SOUTH DAKOTA:
I. That Section 10-42 of the Revised Ordinances of Brookings, South
Dakota, be and the same is hereby amended as follows, to-wit:
Section 10-42. Notice of application.
(a) Except as hereafter provided, no moving permit shall be
issued until notice of application therefor shall have been
given to the owners of real estate adjoining the real estate .•, .'
upon which a building or structure is to be moved, and until
an opportunity has been given such adjoining property owner
to be heard upon such application. Notice of such appli�catiron
shat� be given by publication. in �t}� qfficial newspaper at least . .
.��ve;��� days prior to the date wfien-such applica.tion shall be
consideretl and by mailing a copy of said notice to owners of
. real estate adjoining the real estate upon which the building�
or structure is to be moved. Said notice shall state the time
and place of sai�d hearing and in general terms a description

(b) The requirements in Subsection (a) above shall not apply to
, applications for buiiding permits for moving new structures '.
which have been inspected by the City Engineer`s Office and
comply with all building code requirements. �
II. That any and all ordinances or parts thereof in conflict herewith are
hereby repealed. .
