ORDINANCE NO. 1-73
AN ORDINANCE AMENDING CHAPTER 16 OF THE REVISED ORDIN-
ANCES OF BROOKINGS, SOUTH DAKOTA, PERTAINING TO GARBAGE AND
TRASH AND ESTABLISHING NEW RATES.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
BROOKINGS, SOUTH DAKOTA
I. That the following Sections of Chapter 16 of the Revised
Ordinances of Brookings, South Dakota, be and the same
are hereby amended to read as follows, to�wit:
Sec. 16�24. Monthly charges for family domestic units.
The cost of collection and disposal of refuse for
family domestic units shall become a charge against the
occupant of each dwelling and shall be payable monthly, to-
gether with other public service charges as defined by this
city. A fair and reasonable charge for the collection of the
contents of not more than (2) two cans at each regular collection
time, from each domestic unit shall be two dollars and nof 100
($2. 00) per month.
Sec. 16-25. Nonuser permit.
Any person, firm, corporation, institution, or facility
which from its nature would have no garbage, rubbish or waste
material to be collected or deposited as provided by this chap�
ter, or who sha.11 regularly employ the service of a licensed
garbage hauler, may apply bi�annually to the city auditor for
a nonuser permit upon payment of an application fee of seventy
five cents ($0, 75), and the city auditor will issue such permit
if he finds that the applicant will, in fact, be a nonuser. Any
person holding a nonuser permit may obtain a ticket from the city
auditor for an occasional use or disposal of refuse at the sanitary
landfill upon payment to the city auditor of the sum of seventy^five
($0. 75) cents for each such ticket issued and such tickets shall
be delivered to the landfill supervisor by the purchaser on using
the sanitary landfill,
Sec. 16-26, Monthly charges for commercial establishments.
, The cost of the collection and disposal of refuse from
commercial establishments shall become a charge against the
occupant of such commercial establishments and sha.11 be payable
monthly together with other public service charges as defined by
this city. A fair and reasonable charge for the collection of the
contents of not more than two (2) cans at each regular collection
time shall be five dollars ($5, 00) per month; and the fair and
reasonable charge for the collection of the contents of not more
than four (4) cans at each regular collection shall be eight dollars

and fifty cents ($8. 50}, and there shall be an addit�onal
two dollars ($2. 00) charged for each can in excess of four
(4) cans per collection.
Sec. 16�28. Other monthly charges.
The cost of collectionaid disposal of refuse by
trailer courts, the public schools or any institution or
facility not otherwise classified herein shall be as follows:
(a) A minimum of ten dollars ($10. 00) per month for
not in excess of ten (10) cans or containers per
collection per month.
(b) A minimum of twenty dollars ($20. 00) per month
for eleven (11) to twenty ('20) cans or containers per col-
lection per month.
(c) A minimum of thirty dollars ($30. 00) per month for
twenty-one (21) cans or containers per collection per
month.
(d) The sum of ten dollars ($10. 00) per month for each
; fifteeen (15) cans or containers in egcess of thirty (30)
such cans or containers in all cases.
e The cost of collection and disposal of refuse from

trailer courts shall be charged on a basis af two dollars
($2. 00) per trailer per month in the same manner as
for a family domestic unit.
Sec, 16-47. Charges for use.
Each licensed commercial garbage hauler and each
commercial establishment hauling its own garbage, rubbish
or waste mate�ial shall pay to the city for the use of the sanitary
landfill, per vehicle load or part of a load, the followirig charges:
(�.) For small trailers without a rack, containing a capacity
of approximately two (2) yards the sum of seventy�-five
cents ($0. 75) per load.
(2) For large trailers with rack or small pick�ups without
rack, having a capacity of approximately three (3) yards
the sum of one dollar ($1. 00) per load.
(3) For large pi�k-ups with rack, having a capacity of
approximately five (5) yards the sum of one dollar and
twenty-five ($1. 25) per load.
(4) For small trucks having a capacity of approximately
five (5) to nine (9) yards, the sum of two dollars ($2. 00)
pe r load.
(5) For large trucks having a capacity of ten (10) to twelve
(12) yards the sum of two dollars and seventy-five ($2. 75)
cents.
(6) For small compactors having a capacity of ten (10)
to fourteen (14) yards the sum of three dollars and

(7) For medium size compactors having a capacity_af �
fifteen (15) to eighteen (18) yards, the sum of seven
dollars and fifty cents ($7. 50) per load. .
(8) For large compactors having a capacity of nineteen _
_ (19) to twenty�five (25) yards, the sum of ten c�ollars , :
($10. 00) per load.
Sec, 16�48. Payment of charges.
The charges prescribed in Section 16�47 hereof, shall
be paid in advance at the office of the city auditor in the City '
of Brookir�gs, and the office of the city auditor shall, upon
receipt of payment, issue a ticket or tickets for the pa:rti,cular
load capacity requested. Tickets shall be issued s��el.y ot� a
per load basis and a purchaser may purchase as many ��i�et�" : ,
in advance as he shall desire or deem necessary. -
Sec. 16-49. Supervision of landfill,
The landfill supervisor shall be responsible for the -
control of ingress and egress to the city landfill. He shall
collect all tickets at the gate and shall insure that the ti�kets :
submitted is the appropriate and proper ticket for the s�e�� �` :
load desiring entrance to the city landfill. It shatl be t�e.duty
of the landfill' supervisor to insure that each person d�si�ing'
admittance to the city landfill shall have the proper ticket
based upon the type of vehicle and its capacity and in accordance
with the charges for use as specified in Section 16^47. Nb load
