AN ORDINANCE Ai"lENDING SECTION 300, S�CTION 400, ADDING A
NEW SECTION 405, PERTAINING TO ZONING DISTRICTS AND AMIlVDING
SECTION 790 ANNEXATION OF THE BROOKIl�TGS ZONING ORDIlVANCE OF' 1966
AS A:t"LENDID.
BE IT ORDAINID BY THE GOVERNING BODY OF THE CITY OF
BROOKINGS, SOUTH DAKOTA:
I. That Section 300 and Section 400, of the Brookings Zoning
Ordinance of 1966 as amended be and the same are hereby
amended to read as follows to wit:
Section 300. Establishment of Districts.
For the purpose of this ordinance, the City of
Brookings, South D akota, is hereby divided into
seventeen (17) types of districts:

All of the zoning classifications with the exception
of Flood Way (FW) may be L�sed in flood-plain areas
and if so will carry a pre.�ix FP, e.g., R-7_A,. .becomes
FPR-1A, B-2 becomes FPB-�.r Areas -so .designated`�a�r
be used for purposes outlined in this ordinance pro-
' vided that all construction be designed to withstand
a 100 year flood, such design to be approved by the
City Engineer.

401. General Use Provisions.
l. The pvrpose of this district is to protect
from encroachment that portion of the .
floodplain that is defined as the flo�dwa.y � -
on the "Flood Boundary and Floodway map"
for the City of Brookings prepared by the
U.S. Department of Housing and 'Urban Devel-
opment, Federal Insurance Adm.inistration
with an effective date of October 17, 1978e

The floodway is the channel of a stream plus any
adjac;ent flood plain areas, that must be �ept free
of encroackiment in order that the 100 year flood,
. can be carried without increasing the flood height
� more than one (1) foot. � ,
402a Permitted Uses.
.l Agric�altural purposes such as crop production :
and raising of livestock not requiring a farm
residence or other buildings. ' .
.2 Public parks, playgroun:ds, private recreation�,
shooting range, campgrounds without overnight

406. �General Use Provisions .
.l The purpose of the Agricultural District is to
protect agricultural land and uses from incom-
patible land uses and to limi� residential,
commercial and industrial uses to those areas ,
where they are best suited by reason of their � ;
requirements for public s�rvices and sound develop-
ment. It is also for the preservation of open :_
space and land currently used for intensive i��
agricultural practices. -

.8 Outdoor advertising meaning a sign, device,
figure, drawing, painting, message, poster
billboard or other thing which is designed,
intended or used to advertise or inform, any
part of the advertisin� or information con-

the main-traveled way of any highway.
.9 Hot mix or asphalt plants, provided that an.y
special exception issued for a hot mix or
asphalt plant shall only last for a period
of one year.

.2 Building setback requirements. (General

approval is granted by the Board of Adjustment.
In no case shall a building be located closer
than fifty (50) feet from the public road

.3 Area Regulations. (Residential buildings.) '
All buildings shall be set back from street
right-of-wa.y lines and lot line to comply
with the following yard requirements: � �
. a. I,ot size. All lots s:�all be a minimum
of thirty-five C35) acres.
b. Front yard. The minimum depth of the
front yard shall be three hundred (300) _
feet and in no case shall an accessory
building be located or extended into
- the front yard. Exception: A structure
with a floor space of less than two
hund.red (200) square feet. Front yard
minimum width shall be one hundred
sixty-five (165) feet.
c. Side yard. The minimum width of a side
yard shall be twenty-five (25) feet. . .
d. Rear yard. The mi�.imum depth o� a rear �
yard shall be twenty-five �25) feet
e. Maximum lot coverage. Dwellings and
buildings accessory thereto shall
cover not more than twenty-five (25)
percent of the lo�L area. .

.4 Height regulaticn• , No main residential
building shall exceed two and one-half
(2 1/2) stories or thirty five C35)
feet in height. All structures including
those allowed by special exception must
conform to height regulations in Article
VII, Section 721. Exceptions which may be
allowed by approval of the Board of
Adjustment include: , �
a. Agricultural buildings.
b. Chimneys, smokestacks, cooling towers.
c, Radio and TV towers.
d. Water tanks.
