ORDINANCE NO . 28-80
AN ORDINANCE AMENDING SECTION 34-50 OF THE REVISED
ORDINANCES OF THE CITY OF BROOKINGS PERTAINING TO MANNER
OF ARREST.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
BROOKINGS, SOUTH DAKOTA:
I. That Section 34-50 of the Revised Ordinances of Brookings, South
Dakota, be and the same is hereby �mended to read as follows, :�
to-wit:
Section 34-50. Manner of Arrest.
Except when reasonably necessary to secure appearance,
a person charged by a police officer with �iolation of a pra-� '
vision of this chapter, or a traffic ordinance of the city, or , ..
§ 701. 6 of the zoning ordinance of the City of Brookings, need .
not be arrested in the regular manner but may first �e given ,
an opportunity, after notice, to appear volunta.rily to answer
for such violation. This procedure shall not apply to any
person charged with an offense causing or contributing to an
accident resulting in property damage, or injury or death to
any person, nor to any person charged with wreckless driv�ng, �
nor to any person charged with driving while under the influenCe
of into�icating liquor or narcotic drugs. - -
II. That any and all ordinances or parts thereof in conflict herewith �
are hereby repealed. _
