BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, S011TH DAKOTA: I . That Section 721 of the Brookings Zoning Ordinance of 196b as amended be and the same is hereby amended to rea� as follows, to-wit: Section 721. Brookings Airport Zoning Ordinance. 722. Purpose and Authority. - a. It is herehy fonnd that an airport obstruction �as �he - - potential of endangering the lives and property of users of the Brookings Airport, and property or occu- pants of land in its vicinity; that an obstruction , may effect exist�ng and future instrument approach minimums of Brookings Airport; and that an obstruction may reduce the size of areas available for landing, takeoff, and maneuvering of aircraft, thus tending to destroy or impair the utility of Brookings Airport and the puhlic investment therein. Accordingly, it is declared: 1. The creation or establishnent of an obstruction has the potential of being a public ni�isance and may injure the region served hy Brookings Airport; 2 . It is necessary in Lhe interest of the public health, p»blic safety, and general welfare that the creaLion or establishment of obstructions that are a hazard to air navigation be pr�vented; and � 3. The prevention of these obstructions should be accomplished, to the extent legally possible, by the exercise of the police power withotit compensation. b. The prevention of the creation or establishment o� air- port obstructions and the elimination, removal, altera- tion, mitigation, or marking and lighting of existing obstructions are public purposes for which political subdivisions may raise and expend gublic £und.s, and acq�iire land or interests in lanci. 723. Word Definitions. � As used in this Ordinance, unless the context otherwise requires: . 1 Airport. The area designated and referred to in the Brookings Airport Zoning Map as the Brookings Municipal Airport. . 2 Airport Elevation. The established elevation of 1 ' ,' � ; , , � ' ' ' the highest point on the usable landing area which elevation is established to be 1637 feet above mean sea level. . 3 Approach Surface. A surface longitudinally centered on the extended runway centerline, extending outward and upwa.rd from the end of the primary surface and at the same slope as the approach zone hei ght limitation slope set forth in Section 724 (b) of this Ordinance. In plan the perimeter of the approach surface coincides with the perimeter of the approach zone. , .4 Approach, Transitional, Horizontal, and Conical Zones. These zones are set forth in Section 724 of this Ordinance. . 5 Board of Adjustment. The Board of Adjustment as defined in Section 930. .6 Conical Surface. A surface extending outward .and � upward from the periphery of the horizontal surface at a slope of 20 to 1 for a horizontal distance of 4,000 feet. .7 Dwelling. Any building or portion thereof designed or used as a residence or sleeping place of one or more persons. .8 Hazard to Air Navigation. An obstruction determined to have a substantial adverse effect on the safe and efficient utilization of the navigable airspace. .9 Height. For the purpose of determining the height limits in all zones set forth in this Ordinance and shown on the zoning map, the datum shall be mean sea level elevation vnless otherwise specified. . IO Horizontal Surface. A horizontal plane 150 feet above the established airport elevation, the perimeter of which in plan coincides with the perimeter of the horizontal zone. . 11 Larger than Utility Runway. A r��nway that is con- structed for and intended to be used by propeller driven aircraft of greater than 12,500 pounds � maximum gross weight and jet powered aircra£t. . 12 Nonconfor�ning Use. Any pre-existing structure, object of natural growth, or use of land which is inconsistent with the provisions of this Ordinance or an amendment thereto. . 13 Nonprecision Instrument R unway. A runway having � . an existing instruinent approach procedure utilizing air navigatfon facilities with only horizontal guidance, or area type navigation equipment, for h�hich a straight-in nonprecision instrument approach procedure has been approved or planned. .14 Obstruction. Any structure, growth, or other Qbject, including a mobile object, which exceeds a limiting height set forth in Section 724 (b) of this Ordinance. c- � . 15 Primary Surface. A surface longitudinally entered on � a runway. When the runway has a specially prepared � hard surface the , primary surface extends 200 feet beyond each end of that runwa ; for militar runwa s r y y or when the runwa has no s eciall re ared ha � y p y p p rd surface or lanned hard surface the rimar � P . P Y - Z � . .1 . . , surface ends at each end of that runway. The width of the p;imary s��rface is set forth in Section 724 of this Ordinance. The elevation of any point on the primary surface is the same as the elevation of the nearest point on the runway centerline. . 16 Runway. A defined area on an airport prepared £or �, landing and take-off of aircraft along its length. � . 17 Structure. An object, incl�iding. a mobile object, constructed or installe3 by man, includin� but without limitation, buildings, towers, cranes, sm4kestacks, earth formation, and overhead transmission lines. . 18 Transitional Surfaces. These surfaces extend outward at 90 degree angles to the runway centerline and the runway centerline exten�ed at a slope of seven (7' ) feet horizontally for each foot vertically from the sides of the primary and approach surfaces to where they intersect the horizontal and concial surfaces. -- � � . 19 Tree. Airspace Obstruction Zones and_ H�ight Limitat�ons. a. In order to carry out the provisions of this Ordinance, there are hereby created and established airspace zones which include all of the land lying beneath the approach surfaces, transitional surfacss, horizontal surfaces, and conical surfaces as they apply to Brookings Airport. Such zones are shown on Brookings Airport Zoning Map consisting of one sheet, prepared by Banner Associates, Inc. , Consulting Engineers� Brookings, South Dakota, and dated May, 1978, which is attached to this Ordinance and made a part hereof. The various zones are hereby established and defined as follows: i. Utilit Runwa Visual A roach Zane (Designated as xisting unway an - he inner edge of this appxoach zone coincides with the k•idth of the primary surface and is 250 feet wide. The approach zone expands outward nniformly to a width of 1,250 £eet at a horizontal distance of 5,400 feet from the primary surface. Its centerline is the continuation of the centerline of the runway. 2. iTtilit Runwa Non recision Instrwnent A roach one esignate as U timate unway - T e i nn er edge of this approach zone coincides with the width of the primary surface and is 500 feet ' � wide. The approach zone expands outward uniformly to a width of 2 �000 feet at a horizontal distance 5,000 feet from the primary surface. Runwa Lar er Than Utilit w'ith A Visibilit Minimum s ow s le on recision nstrument roac one esignate as Runway - e nner e3ge—of this approach zone coincides with the width of the primary surface and is 1,000 feet wide. The approach zone expands outward uniformly to a width of 4,000 feet at a horizontal distance o£ 10,000 feet from the pri- mary surface. Its centerline is the continuation of the centerline of the runway. 3 . , , . , 4. Transitional Zone - The transitional zones are t e areas eneat the transitional surfaces. S. tiorizontal Zone - The horizontal zone is estab- is e y swinging ares of 10,000 feet radii from the center of each end of the primary surface of Runway designated as R�inway 12/30 and connecting the adjacent ares by drawing lines tangent to those ares. The horizontal zone does not include the approach and transitional zones. 6. Conical Zones - The conical zone is established as t e area that commences at the periphery of the hdrizontal zone and extends outward therefrom a horizontal distance of d,000 feet. b. ExcepL as otherwise provided in this Ordinance, no structure shall be erected, altered, or maintained, and no tree shall be allowed to grow in any airspace zone created by this Ordinance to a height in excess of the applicable height limit herein established for such zone. Such applicable height Iimitations are hereby established for each of the zones in question as follows: • 1. Transitional Zones - Slope seven (7' ) feet outwar or eac oot upward beginning at the sides of and at the same elevation as the primary surface and the approach surface,. and extending • . to a height of 150 feet above the airport eleva- tion which is 1,637 feet mean sea level. In addition to the foregoing, there are estab- lished height limits sloping seven (7' ) feet . outward for each foot upward beginning at the sides of and at the same elevation as the approach surface, and extending to Where they intersect the conical surface. � 5. Horizontal Zone - Established at 150 feet above t e airport e evation or at a height of � 1,787 feet above mean sea level. 6. Conical Zone - Slopes twenty (20' ) feet outward � �or eac oot upward beginning at the periphery of the horizontal zone and at 150 feet above the airport elevation and extending to a height of - ' 350 feet above the sirport elevation. 4 . , �,�� , ?25. Land use safety zoning and use restrictions. a. In order to carry out the purpose of this Ordin�nce, as set £arth above and a1so, in order to restrict those uses which may be hazardous to the operational safety of aircraft aperating to and from Brookings Airport, and f�lrthermore to limit population and huilding den- sity in the runway approach areas, thereby creating sufficient open space so as t� protect life and pro- perty in case of an accident, there are herehy created and established the foll�wing land use safety zones. 1. Safety_ Zone A - All land in that portion of the approac zones of a runk�ay, as defined in Section 724 hereof, which extends outward from the end of the primary surface a distance equal to one-third of the planned length of the runway, which distance shall be: a. 1809 feet for runway 12I30; . b. 1200 feet for ulti�tate runway 18/36. 2. Saf ety_Zone B - All land in that portion of the approac�es o£ a runway, as defined in Section 724 hereof, which extends outward from Safety Zone A a distance eq�1a1 to two-thirds of the planned length of t}�e r�mway, which length shall be: a. 3619 feet for runway 12/30; b. 2400 feet for ultimate runway 18/36. 3. Safety Zone C - All that land which is enclosed wit in t e perimeter of the horizontal zone, as defined in Section 724 hereof, and is not included in Safety Zone A or B. b. Use Restrictions. 1. General - Subject at all times to the height rest ictions set forth in Section 724 (b) hereof, . no i�se shall be made of any land in any o£ the safety zones �efineei in Section 725 (a) which � creates or causes interference with the operations of radio or electronic facilities on the airport or with radio or electronic commnnicatians between the Rirport and aircraft, ' makes it difficult for pilots to distinguish between airport lights and other lights, results in glare in the eyes of pilots using the airport, i� airs visibility- in the vicinity of the airport, p off or � or otherwise endangcrs the lanclins, takins , maneuvering of aircraft. 2. Safet Zone A - Subject at all times to the e g t restrictions set forth in Section 724 (b) hereof, and to the general restrictions contained � in Section 725 (b) (1) , areas designated as Safety Zone A shall contain no buildings or temporary strnc- tures, exposed transmission lines, or other similar land use structural hazards and shail be restricted to those uses which will not create, attract, or bring together an assembly of persons thereon. Permitted uses may include agriculture (seasonal crops), horticulture, wildlife habitat, light outdoor recreation, cemeteries and auto parking. S ' � . � . , � � � � • • 3. Safet Zone B - Subject at all times to the eig t restrictions set forth in Section 724 tb) hereof, and to the general restrictions con- - tained in Section 725 (b) (1) � areas designated as Safety Zone B shall be restricted in use as follows: a. Each use shall be on a site whose area shall not be less than one-half acre. A dwelling, where permitted, shall be considered as one use. b.• A huilding plot shall be a single, uniform and noncontrived area, whose shape is uncomplicated and whose area shall not exceed the following minimimn ratios with respect to the total site area: Site Area But Less Ratio of Building Max. Each use shall conform to zoning require- ' ments. d. The following uses are specifically prohibited in Zone B: churches, hospitals, schools, theaters, stadiums, hotels and motels, trailer courts, camp grounds, and other places of public assembly. � 4. Safet� Zone C - Safety Zone C is subject only � to�iei t restrictions set forth in Section 724 (b� hereof, and to the eneral restrictions contained in Section 725 (b� (1). II . That any and all ordinances or parts thereof, in conflict herewith, are hereby repealed.
