HomeMy WebLinkAboutOrdinance 20-1983 • • ORDINANCE NO. 20-83 AN ORDINANCE AMENDING CHAPTER 30, ARTICLE II OF ORDINANCE NO. 715, THE REVISED ORDINANCES OF THE CITY OF BROOKINGS, PERTAINING TO THE CITY PLANNING COMI�ZISSION. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA: I . That Article II, Chapter 30 of Ordinance No. 715 be and the same is hereby air.�ended to read as follows, to-wit: Section 30-30 . Employment of Staff The City �ommission may appoint such employees as it may deem necessary for its work, whose appointment, promotion demotion and removal shall be subject to the same pro- visions of law, including civil service regulations, as govern other corresponding civil employees of the munici- pality. The compensation of all such employees shall be fixed by the City Commission. Section 30-31. Contracts The City Commission may also contract with City Planners, Engineers, Architects, and other consultants as well as federal , state, and local agencies for such services as it may require. Section 30-32. Miscellaneous Powers . All public officia.ls shall, upon request, furnish to the Planning Commission, within a reasonable time such available informat�_on as it may require for its work. The plan com- mission, its members and employees in the performance of its functions ma enter u on an land make examinations and � Y P Y � surveys and place and maintain necessary monuments and markers thereon. In general, the planning commission shall have all such powers as may be necessary to enable it to fulfill and perform its functions, promote municipal planning, or carry out all the purpose of this chapter. The expenditures of the planning� commission, exclusive of those made from funds received by gift, shall be within the amounts appropriated for the purpose by the local legislative body, �ahich shall provide the funds, equipment, and accommodations necessary for the com�ission's work. Section 30-33 . Ma.ster Plan. No change. Section 30-34. Same - General Purposes. No change. Section 30-35 . Same - Adoption The planning commission shall propose to the council the comprehensive plan as a whole by a single resolution or, as the work of making the whole comprehensive plan progresses, may from time to time propose a part or parts thereof, any such part to correspond generally with one or more of the functional sub-divisions of the subject matter of the plan. Before recommendations to the commission of the comprehensive plan or part thereof, the planning commission shall hold at least one public hearing, notice of the time and place of which shall be given at least fifteen days in advance by publication in a newspaper having general circulation in the community. The planning commission shall submit the recommended comprehensive plan or part thereof to the state planning bureau for its information, at the same time it is submitted to the city commission. 1 The adoption by the City commis��on of the plan or any part, amendment or additions, shall, following the same type of notice and public hearing as required above, be by resolution carried by the affirmative votes of not less than a majority of all the members of the commission. The resolution shall- refer expressly to the maps, descriptive matter, and other matters, � intended by the commission to form the whole or part of the plan, and the action taken shall be recorded on the adopted 'I plan or part thereof, by the identifying signature. Section 30-36. Legal Status . No Change. Section 30-37 . Building or Setback Lines From and after the time when the city commission shall have � adopted a comprehensive plan which includes at least a major street plan or shall have progressed in its comprehensive planning to the stage of the making and adoption of a major street plan, the planning commission may recommend and the city commission is hereby authorized and empowered by ordi- nance to establish, regulate and limit, and to change and amend, building or setback lines on such streets and to prohibit any new building being located within such building or setback lines. The regulations authorized by this section shall not be adopted, changed or amended until a public hearing has been held thereon, following the same notice as provided in 30-35 . The City Commission may provide for a board of adjustment, or may authorize the planning and zoning commission to serve as a board of adjustment �to make special exceptions or grant variances to the adopted regulations in specific cases, in order that unwarranted ha.rdship, which constitutes an un- reasonable deprivation of use as distinguished from mere grant of privilege, may be avoided.
