ORDINANCE N0. 10-85
AN ORDINANCE AMENDING ORDINANCE N0. 647 OF THE CITY OF
BROOKINGS, SOUTH DAKOTA, AN ORDINANCE GRANTING A FRANCHISE TO
KOTA CABZE TV COMPANY OF BROOKINGS, SOUTH DAKOTA, ITS SUCCESSORS
AND ASSIGNS, TO OPERATE AND MAINTAIN A COMM[TNITY ANTENNA TEZEVISION
SYSTEM IN THE CITY OF BROOKINGS, SOUTH DAKOTA; SETTING FORTH �ONDITIONS
ACCOMPANYING THE GRANT OF FRANCHISE; PROVIDING FOR CITY REGULATION
AND USE OF THE COMMUNITY ANTENNA TELEVISION SYSTEM; PRESCRIBING
PENALTIES FOR VIOLATION OF THE FRANCHISE PROVISIONS; AND PROVIDING
FOR AN ELECTION THEREON.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS,
SOUTH DAKOTA:
'i . That Chapt er XXIX of Ordinanc e No. 647 be and the same i s
hereby amended as follows, to-wit :
XXIX
Violations.
'I . It shall be unlawful for any person, firm or corporation
to make any unauthorized connection, whether physically,
electrically, acoustically, inductively or otherwise, to
any part of a franchised CATV system within the City of
Brookings, South Dakota, for the purpose of taking or
receiving television signals, radio signals, pictures,
programs, or sound.
2. It shall be unlawful for any person, firm or corporation
to make any unauthorized connection, whether physically,
electrically, acoustically, inductively, or otherwise, to
' any part of a franchised CATV system witYiin the City of
Brookings, for the purpose of enabling himself or others
to receive any television signal, radio signal, p�;cture,
program or sound, without payment to the owner of said
system.
3. It shall be unlawful for any person, without the consent
of the owner, to willfully tamper with, remove or injure
any cables, wires or equipment used for distribution of
television signals, radio signals, pictures, programs,
or sound.
4• It shall be unlawful ior any person, �irm or corporation '
to wilfully obtain, receive or take television signals,
radio signals, pictures, ?arograms, or sound furnished by
a franchised CATV syster.i within the City of �rookings, '�
South Dakota, through decention, unauthorized connection ',
or other means to avoid payment for the said services.
II. That any and all ordinances or parts thereof in conflict herewith
