th'�iEREAS this body adopted an Ordinance �ranting a franchise
to KOTA Cable T.IT. Comp�ny of �3rookijigs, South nakota, on t;arch
21 , 1978 which franc}iise �aas approved by the voters of the City
of Brookings, and has been amenc�ed from time to time thereafter,
and
Fti'IfEREAS, the francliise Ordinance provides for certain
responsibilities and duties of the Grantee therein, to include
Signal Quality F�ec�uirements as s�ecified in Article VIII
thereof, Operations and P4aintenance in Ar. ticle IX thereof and
said Ordinance further rec�uires payrnent of certain franchise
fees to the City of. Brookin�s as is set fortll iri Article XXII
thereof, as amended, and
WIIEF.�AS, K�TA Cable T.�T. has failec3 to r.►aintain signal
quality requirenents and lias failed to maintain the system in a
good and efficient matter and lias furtlicrmore failed to pay in a
timely matter all of the francliise fees due thc City of
Erookin�s, now tlierefore,
BE IT ORDAIrIEP BY TNE GOV�RNING BODY OF T.iE CITY OF
I:ROOKINGS t}iat Ordinance No. 647 of the City of �raokings be and
the same is hereby repealed and Grantees rights thereunder are
hereby terminated ,
