ORDINANCE N0. 15-86
AN ORDINANCE OF THE CITY OF BROOKINGS, SOUTH DAKOTA,
AMENDING ARTICLE II OF CHAPTER 10, OF THE REVISED ORDINANCES OF
THE CITY OF BROOKINGS, SOUTH DAKOTA TO PROVIDE FOR THE ADOPTION
OF THE 1985 EDITION OF THE UNIFORM BUILDING CODE, AND AMENDMENTS
THERETO.
I .
That Section 10-17 of the Brookings Ordinances shall be
amended to read as follows :
There is hereby adopted by the City for the purpose of
establishing rules and regulations for the construction,
alteration, removal , demolition, equipment, use and occu-
pancy, location and maintenance of buildings and struc-
tures, including permits and penalties , that certain
building code known as the "Uniform Building Code, 1985
Edition, together with Appendix Chapter 23 Division I ,
Alternate Snow Load Design, Appendix Chapter 32, Re-
roofing, and Appendix Chapter 70 Excavation and Grading
(Section 7007 thereof deleted) ; the Uniform Building Code
Standards, 1985 Edition" published by the International
Conference of Building Officials save and except such por-
tions as are hereinafter deleted, modified or amended, of
which not less than three (3) copies have been and now are
filed in the office of the city finance officer and the
same is hereby adopted and incorporated as fully as if set
out at length herein, and the provisions thereof shall be
controlling in the construction of all buildings and other
structures therein contained within the corporate limits of
the city.
II .
Sec. 10-22 . Amendments to Uniform Building Code.
The City of Brookings hereby adopts Amendments to Uniform
Building Code, 1985 Edition, which shall immediately be filed
in the office of the city finance officer and the same are hereby
adopted and incorporated in the Uniform Building Code, 1985
Edition as adopted by the city, said Amendments being incor-
p�rated as fully as if set out at length herein, and the provi-
sions thereof shall be controlling in the construction of all
buildings and other structures therein contained within the cor-
porate limits of the city, and shall supercede all provisions of
the Uniform Building Code, 1985 edition in conflict thereof.

ARTICLE II OF CHAPTER 10, OF THE CODfi OF ORDINANCES OF THE CITY OF
BROOKINGS , SOUTH DAKOTA, TO PROVIDE FOR THfi ADOPTION OF THE 1985
EDITION OF THE UNIFORM BUILDING CODE, AND AMENDMENTS THERETO.
That Section 10-17 of the Brookings Ordinances shall be amended to
read as follows :
There is hereby adopted by the City for the purpose of

"Uniform Building Code, 1985 Edition, together with Appendix

Re-roofing, and Chapter 70 Excavation and Grading with Section
7007 deleted; the Uniform Building Code Standards, 1985 Bdition" ,
published by the International Conference of Building Officials
save and except such portions as are hereinafter deleted, modified
or amended, of which not less than three (3} copies have been and
now are filed in the office of the City Finance Officer and the
same is hereby adopted and incorporated as fully as if set out at
length herein, and the provisions thereof shall be controlling in
the construction of all buildings and other structures therein
contained within the corporate limits of the city.
SECTION 10-22 ADDITIONAL AMENDMENTS .
That Section 10-22 of the Brookings Ordinances shall provide that
Section 104(e) , Moved Buildings and Temporary Buildings, of the Uniform
Building Code, 1985 Edition, be amended to read as follows:
Buildings or structures moved into or within the jurisdiction
shall comply with the provisions of this code for new buildings or
structures.
Temporary structures and other miscellaneous structures may
be erected by permit from the Building Official for a limited
period of time. Such building need not comply with the type of
construction or fire-resistive time periods required by this code.
Temporary buildings or structures shall be completely removed upon
expiration of the time limit stated in the permit .

That Section 10-22 of Brookings Ordinances shall provide that
Section 301 (a) , Permits Required, of the Uniform Building Code, 1985
Edition be amended to read as follows :
Except as specified in Subsection (b) of this section, no
building or structure regulated by this code shall be erected,
constructed, enlarged, altered, prepared, moved, improved,
removed, converted or demolished unless a separate permit for each
building or structure has first been obtained from the Building
Official. Permits for minor work may be exempted by the Building
Official or his designate.
That Section 10-22 of the Brookings Ordinances shall provide that
Section 303(d) , Expiration, of the Uniform Building Code, 1985
Edition, be amended to read as follows:
365 days to replace 180 days .
That Section 10-22 of the Brookings Ordinances shall provide that
Section 304(e) , Work Without a Permit , of the Uniform Building Code,
1985 Edition, be amended to read as follows:
Whenever any construction or work for which a permit is
required by these codes is started or commenced without obtaining
the prescribed permit , the fees specified in this section may be
increased by the Building Official or his authorized official , up
to a double fee, but the payment of such increased fees shall not
relieve any persons from fully complying with the requirements of
these codes in the execution of the work nor from any other
penalties prescribed he�ein .
That Section 10-22 of the Brookings Ordinances shall provide that
Section 305 (c) , Inspection Record Tags or Cards , of the Uniform
Building Code, 1985 Edition, be amended to read as follows:
Inspection record tags or cards placed on the job by
inspectors to indicate approval of work inspected shall not be
removed, except when authorized by an inspector.
That Section 10-22 of the Brookings Ordinances shall provide that
Section 305 (e) , Required Inspections, of the Uniform Building Code,
1985 Edition, be amended to read as follows :
Reinforcing steel or structural framework of any part of any
building or structure shall not be covered or concealed without
first obtaining the approval of the building official .
The building official , upon notification from the permit
holder or his/her agent, shall make the following inspection and
shall either approve that portion of the construction as
completed, or shall notify the permit holder or his/her agent
wherein the same fails to comply with this code;

1 . FOOTING INSPECTION: To be made after excavations for
footings are complete and required forms and reinforcing
steel is in place. Where the footing is to be constructed
of approved treated wood, additional inspections may be
required by the building official .
2. FOUNDATION LOCATION INSPECTION: Inspection to be made after
footing inspection, may be made along with footing inspection
provided batter boards , string lines or other such form lines
' of foundation are in place. All property corners shall be
exposed and visable when this inspection is made. All
construction material including dirt shall be clear of
property lines.
3. FRAME INSPECTION: To be made after the roof, all framing,
fire blocking and bracing are in place and all pipes ,
chimneys and vents are complete and the rough electrical ,
plumbing and heating wires , pipes and ducts are approved.
4. FINAL INSPECTION: To be made after the building is completed
and ready for occupancy.
That Section 10-22 of the Brookings Ordinances shall provide that
Section 307(e) , Posting, of the Uniform Building Code, 1985 Sdition,
be amended to read as follows:
The certificate of occupancy shall be posted in a conspicuous
place on the premises except in one and two family dwellings where
a placard will be posted to indicate when occupancy is permitted.
The certificate and placard shall not be removed except by the
Building Official or his/her authorized representatives.
That Section 10-22 of the Brookings Ordinances shall provide that
Table 3-A, Building Permit Fees , of the Uniform Building Code, 1985
Edition, be deleted:
That Section 10-22 of the Brookings Ordinances shall provide that
Section 1204, Exits and Emergency fiscapes, of the Uniform Building
Code, 1985 Edition, be amended to read as follows:
Every sleeping room below the fourth story shall have at
least one operable window or exterior door approved for emergency
escape or rescue. The unit shall be operable from the inside to
provide the following openable area.
The minimum clear openable area for all rescue and escape
windows shall be 20 inches by 24 inches. Where windows are
provided as a means of escape or rescue they shall have a finished
sill height not more than 48 inches above the floor.

Bars , grills, grates, or similar devices may be installed on
an emergency escape or rescue windows or doors, provided:
i . Such devices are equipped with approved release mechanisms
which are openable from the inside without the use of a key
or special knowledge or effort ; and
2. The building is equipped with smoke detectors installed in
accordance with Section 1210.
That Section 10-22 of the Brookings Ordinances shall provide that
Section 1205(a) , Light and Ventilation, of the Uniform Building Code,
1985 Edition, be amended to read as follows :
All guest rooms , dormitories and habitable rooms within a
dwelling unit shall be provided with natural light by means of
exterior glazed openings with an area of not less than five
percent of the floor area of such rooms. All guest rooms ,
dormitories and habitable rooms within a dwelling unit shall be
provided with natural ventilation by means of openable exterior
openings with an area of not less than five percent of the floor
area in such rooms .
All bathrooms , water closet compartments , kitchens, laundry
rooms and similar rooms shall be provided with natural ventilation
by means of openable exterior openings with an area of not less
than five percent of the floor area of such rooms with a minimum
of one and one-half square feet . In lieu of required exterior
openings for natural ventilation; bathrooms, water closet
compartments , kitchens , laundry rooms and similar rooms, a
mechanical exhaust system, vented directly to the outside, capable
of providing five air changes per hour, shall be provided.
For the purpose of determining light and ventilation
requirements, any room may be considered as a portion of an
adjoining room where one half the area of the common wall is open
and unobstructed and provides an opening of not less than ten
percent of the floor area of the interior room or twenty-five
square feet, whichever is greater. '
Required exterior openings for natural light and ventilation
shall open directly onto a street or public alley or yard or court
located on the same lot as the building.
EXCEPTION: Required windows may open into a roofed porch
where the porch: ( 1) abuts a street , yard or court, (2) has
a ceiling height of not less than seven feet and (3) has a �
longer side of at least 65 percent open and unobstructed.

That Section 10-22 of the Brookings Ordinances shall provide that
Section 1709(a) , Parapets-General , of the Uniform Building Code, 1985
Edition, be amended to read as follows:
Parapets shall be provided on all exterior walls of buildings .
EXCEPTIONS :
1 . Walls which are not required to be of fire-resistive
construction.
2. Walls which terminate at roofs of not less than two-hour
fire-resistive construction or roofs constructed entirely of
noncombustible materials .
3 . Walls , where due to location on property, protected openin s

That Section 10-22 of the Brookings Ordinances shall provide that
Section 2301 , General Design Requirements , of the Uniform Building
Code, 1985 Edition, be amended to read as follows:
SCOPE : This chapter prescribes general design requirements
applicable to all structures regulated by this code. It shall not
be the responsibility of the Building Official to determine that a
structure meets the requirements of this chapter or any other
engineering requirements of this code.
That Section 10-22 of the Brookings Ordinances shall provide that
Section 2305(d) , Snow Loads, of the Uniform Building Code, 1985 Edition
be amended to� read as follows:
Roof slopes with a rise of 3 inches or less to the foot shall
be designed for possible snow loads of 30 pounds per square foot
of horizontal projection. Roof slopes with over 3 inches of rise
per foot must be designed for possible snow loads of 20 pounds per
square foot of horizontal projection. Roofs shall also be
designed for wind load based on basic wind speed of 100 mph.
Potential accumulation of snow at valleys , parapets, roof
structures , and offsets in roofs of uneven configurations shall be
considered. Where snow loads occur, the snow load shall be per
Appendix Chapter 23, U.B . C .

That Section 10-22 of the Brookings Ordinances shall provide that
Section 2311 (b) , Basic Wind Speed, of the Uniform Building Code, 1985
Edition, be amended to read as follows :
The minimum basic wind speed for determining design wind
pressure shall be 100 miles per hour.
That Section 10-22 of the Brookings Ordinances shall provide that
Section 2�16(f) 4(ii ) , two or more dwelling units and hotels, of the
Uniform Building Code, 1985 Edition, shall be deleted.
That Section 10-22 of the Brookings Ordinances shall provide that
Section 2907(a) , General , of the Uniform Building Code, 1985 Edition,
be amended to read as follows:
Footings and foundations , unless otherwise specifically
provided, shall be constructed of masonry, concrete or treated
wood in conformance with U. B. C. Standard No. 29-3 and in all cases
shall extend 42 inches below the adjacent finished grade line
except for buildings and structures conforming to requirements
under Exception 1 of Section 2907(b) as amended. Footings of
concrete and masonry shall be of solid material . Foundations
supporting wood shall extend at least 6 inches above the adjacent
finish grade.
That Section 10-22 of the Brookings Ordinances shall provide that
Section 2907 (b) , Bearing Walls, of the Uniform Building Code, 1985
Edition, be amended to read as follows :
Bearing walls shall be supported on masonry or concrete
foundation or piles or other approved foundation system which
shall be of sufficient size to support all loads .
EXCEPTIONS:
l . A one-story wood or metal framed building not used for human
occupancy and not over 1 , 500 square feet in floor area may
have foundations not extending below the frost line. It may
be constructed with walls supported of a concrete slab with
edges below finish grade when approved by the building
official .
2 . The support of buildings by posts imbedded in earth shall be
designed as specified in Section 2907(g) . Wood posts or
poles embedded in earth shall be pressure treated with an
approved preservative. Steel posts or poles shall be
protected as specified in Section 2908(h) .

3 . A grade beam located directly below a bearing or nonbearing
wall will be necessary for any building not conforming to
fixception 1 above. A grade beam must extend 42 inches below
the finished grade line.
That Section 10-22 of the Brookings Ordinances shall provide that
Appendix Chapter 70 . Section 7001 . Purpose, of the Uniform Building
Code, 1985 Edition, be amended to read as follows :
The purpose of this chapter is to safeguard life, limb,
, property and the public welfare of regulating grading on private
property. All references to the Building Official are hereby
revised to the City Engineer.
That Section 10-22 of the Brookings Ordinances shall provide that
Appendix Chapter 70 . Section 7003. Permits Required . 9, of the
Uniform Building Code, 1985 Edition, be amended to read as follows:
9. A fill less than one foot in depth and placed on natural
terrain with a slope flatter than five horizontal to one
vertical , or less than three feet in depth, not intended to
support structures, which does not exceed 200 cubic yards on
any one lot and does not obstruct a drainage course.
That Section 10-22 of the Brookings Ordinances shall add new Item
10 to Appendix Chapter 70. Section 7003. Permits Required. As
follows:
10. Excavation, removal or stockpiling of rock, sand, dirt,
gravel , clay or other like material, as may be required by
the state, county, or city authorities in connection with the
construction or maintenance of roads and highways . This
shall not exempt work for street construction when such work
is performed by private developers. When the private
developer has obtained a permit to perform site grading, a
second permit will not be required for street construction
provided the original permit has addressed the total scope of
work.
That Section 10-22 of the Brookings Ordinances shall provide for
revising of Appendix Chapter 70 . Section 7007. Grading Fees, of the
Uniform Building Code, 1985 Edition, shall be deleted.
