WHEREAS, on the 18th day of March, 1986, there was filed with '�:�";:.
the City Finance Officer of the City of Brookings, petitions re- M'��'
questing that Ordinance No. 7-86 be adopted and referred to the . ���'

NOW, THEREFORE, BE IT RESOLVED By the City Commission of the '°;;=;°
City of Brookings to submit the following Ordinance to a vote of

hours of 8 :00 o 'clock A.M. and 7 :00 P.M. at the established ;r`�'

AN ORDINANCE AMENDING CHAPTER 33 OF THE REVISED ORDINANCES `�'�
OF THE CITY OF BROOKINGS� SOUTH DAKOTA,
REGARDING THE CONSTRUCTION OF SIDEWALKS � , �
BE IT ORDAINED BY THE CITY OF BROOKINGS, SOUTH DAKOTA:

I . That Chapter 33 of the Revised Ordinances of the City of
Brookings, South Dakota, be and the same is hereby amended to
add two new sections to read as follows:

SEC. 33-25. NOTICE TO ADJOINING PROPERTY OWNERS TO CONSTRUCT

1 . Whenever the City Commission shall deem it necessary to w;<:
construct and install any sidewalk, it shall notify all �;;�-
owners of lots affected by such proposed sidewalk :�fy;;:;
construction and installation thereof within the time ��'
hereinafter designated. �`��.
2 . Such notice shall be in writing and be served personally
on each owner by registered mail and by publication once
each week for two consecutive weeks; the notice shall set
forth the character of the work and the time within which f"�<,��
it is to be completed. Such notice may be general as to
the owners but must be specific as to the description of `'`
such lots.
SEC. 33-26. PROTEST AGAINST CHANGE
It shall be unlawful for the City Commission to require
the construction and installation of any sidewalk when-
ever the owners of 50� or more of the area of the lots
affected thereby, within an Addition to, or Subdivision :�, �
of, the City of Brookings, file a Petition with the City
Finance Officer requesting the City Commissioners to
abandon its plans to construct and install said
;:,�
sidewalks.
II. That all ordinances or parts of ordinances in conflict '
herewith are hereby repealed.
Adopted this 18th day of March, 1986.
